Before you rely on a plan

A state rule does not tell you whether a plan covers your issue. Check the product, effective date, existing-matter rules, lawyer network, and extra costs.

A detail worth knowing

Courthouse kiosks can provide access to legal tools when home internet or printing is unavailable, but free access does not necessarily mean free printing. Arkansas Law Help advises checking charges at the location and asking about possible printing-fee relief. Source: courthouse kiosk guidance.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Arkansas. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $5,000 for eligible contract or personal-property disputes.

The Judiciary describes this as a self-representation forum with relaxed evidence rules. It covers contracts, damage to personal property, and recovery of personal property; do not assume every injury or higher-value claim belongs here.

Arkansas Judiciary: district and small-claims courts

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Covered rentals have a 60-day refund and itemized-deductions rule.

The Attorney General identifies landlord size as an important coverage condition. Ask a local lawyer whether the deposit statute applies to your ownership and management arrangement before relying on its deadline. Keep the lease, vacancy record, and deduction statement.

Arkansas Attorney General: deposit protections and coverage

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

A non-holographic will requires the maker's signature and at least two witnesses.

The maker declares the document is a will and signs or acknowledges it before the witnesses; witnesses sign at the maker's request and in their presence. The maker's signature goes at the end. Handwritten wills follow a separate rule, not a shortcut for a typed form.

Arkansas Judiciary probate benchbook: execution, page 7

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

A wholly handwritten body and signature can qualify without signing witnesses, but later proof needs three credible disinterested handwriting witnesses. Those are witnesses to handwriting and signature, not people required to attend execution. A handwritten note can therefore leave a harder probate task; ask a plan lawyer whether a properly witnessed replacement is appropriate.

Arkansas Code 28-25-104 (official publisher), rechecked October 16, 2026

With children, a spouse's rights include a one-third life interest in qualifying land, not outright ownership of the whole estate. Dower or curtesy, relinquished rights, deeds, homestead, and separate personal-property rules need individual review. Ask who can use, sell, or inherit the home rather than treating every asset as a single percentage calculation.

Arkansas Code 28-11-301 (official publisher), rechecked October 16, 2026

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will my plan lawyer arrange valid signing, review an existing handwritten will's proof problems, and explain spouse and children's rights in the home alongside deeds and beneficiary accounts? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Arkansas: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Either spouse must have lived in Arkansas for 60 days before filing and three full months before the decree.

Residency needs independent corroboration. Ask a lawyer to check venue, service, proof, and separate child-custody jurisdiction rather than choosing a court based on the wedding location.

Arkansas Code 9-12-307 (official publisher), rechecked October 16, 2026

Grounds & separation

The ordinary no-fault route requires 18 continuous months living apart without cohabitation; fault grounds also exist.

A witness or affidavit must corroborate the separation. Ask whether the actual facts support a ground before buying a document package or assuming agreement alone permits divorce.

Arkansas Legal Aid: divorce grounds and proof

Timing: what starts the clock

Ordinarily a decree cannot issue before the 30th day after filing; statutory exceptions do not make completion automatic.

The separate residency and applicable separation requirements still matter. Ask the court or a lawyer which timing rule applies, and allow for service, missing proof, contested issues, and scheduling.

Arkansas Code 9-12-310 (official publisher), rechecked October 16, 2026

Property & debts

Marital property starts with equal division, but the court can explain an unequal division it finds equitable.

Separate-property exceptions and tracing matter. The property presumption is not a promise that each debt is split in half; ask for review of balances, creditor obligations, and retirement transfers.

Arkansas judiciary: property division and debts

Spousal support

Alimony is discretionary; financial need and ability to pay are the main considerations.

Income, resources, health, marriage length, and other circumstances can matter. Bring a realistic budget and ask whether the plan covers advice only or also negotiating and requesting support.

Arkansas judiciary: alimony factors

Parenting & child support

Original custody proceedings have a rebuttable joint-custody presumption, not an unconditional entitlement.

Best interests, the statutory rebuttal routes, and abuse or sex-offender restrictions matter. Ask about the actual schedule and safety; do not assume the same presumption controls every later modification.

Arkansas Code 9-13-101 (official publisher), rechecked October 16, 2026

Agreed & simpler processes

Agreement does not remove independent proof requirements for residency or continuous separation.

Those facts can be supported by another person's testimony or verified affidavit in an uncontested case. A prepaid review can check the settlement and missing proof before filing; both spouses' signatures alone may not finish the case.

Arkansas Code 9-12-306 (official publisher), rechecked October 16, 2026

Help while a case is pending

During the case the court can allow maintenance, reasonable attorney fees, and expert-witness fees.

These are discretionary requests, not automatic benefits of filing or enrolling in a plan. Ask who will prepare the request, what financial evidence is needed, and whether representation costs extra.

Arkansas Code 9-12-309 (official publisher), rechecked October 16, 2026

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Legal aid and finding a lawyer

Arkansas Law Help lists both a helpline and an online application for free legal aid. Access to information or a kiosk is different from an attorney accepting your case. Ask the program about its eligibility review and the assistance available for your location and issue. Source: legal-aid starting points.

Before paying for a plan or service

Does the paid service include an Arkansas attorney who can review the legal issue, or only access to forms? Ask who handles local filing requirements, service, hearings, and any additional work if the matter becomes disputed.

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

The fee-waiver guide describes court review of income and assets and says relief, if granted, can cover clerk filing charges and sheriff service of the listed case papers. Confirm the applicable fees with the local clerk and the scope of the order; private legal-service charges are a separate budget item. Source: costs and fee relief.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
