A detail worth knowing

The courts describe a Limited Legal Assistance Program offering a one-time, fifteen-minute meeting for eligible self-represented people. That meeting is not ongoing representation or a promise that the lawyer will appear in court. Check current availability and eligibility before relying on it. Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Delaware. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Justice of the Peace civil claims can reach $25,000.

This court handles eligible debt, property-recovery, and property-damage claims, not every legal problem below the dollar limit. Individuals may proceed without an attorney, but a consultation can help identify the correct claim, evidence, and service procedure before filing.

Delaware Courts: Justice of the Peace civil proceedings

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Generally 20 days after the rental agreement expires or ends.

Deductions require an itemized damages list, repair estimates, and the balance. Provide a forwarding address in writing before leaving; missing address information affects notice duties and double damages. Accepting the refund with its damages list counts as agreement unless you object in writing within 10 days of receipt.

Delaware Code title 25 section 5514(e)-(h)

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills need a signature and at least two credible witnesses in the maker's presence.

Someone else may sign at the maker's express direction and in their presence. The statute has a separate out-of-state recognition provision. A prepared form still needs the appropriate signing procedure; ask the lawyer about execution, not just the wording of the document.

Delaware Code title 12 section 202

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwriting alone does not waive ordinary witnessing requirements. Do not mistake a handwritten gift list for a complete will. Ask the covered lawyer how to document personal wishes and whether customized provisions, revisions, and signing assistance are included.

Delaware Code, Title 12, 202: execution

With descendants, the spouse's personal-property share differs from the real-estate life interest. All-shared descendants: first $50,000 plus half the remaining personal estate; nonshared descendants: half the personal estate. In both cases the spouse receives a life estate in intestate real estate, not outright ownership of it. Review housing and children's future interests together.

Delaware Code, Title 12, 502

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Can my plan lawyer explain who would own the home after each spouse's death and coordinate the will with its title, rather than assuming the survivor receives the whole property? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details

Delaware: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Usually, either spouse needs six continuous months of residence or military stationing.

A limited statutory exception covers certain Delaware same-gender marriages when the home jurisdiction does not permit dissolution. Ask about jurisdiction before choosing a court, especially if children or assets are elsewhere.

Delaware Code, Title 13, 1504

Grounds & separation

Irretrievable breakdown can be based on voluntary separation or incompatibility.

Misconduct and mental illness are other statutory routes. Separation may occur under one roof with separate bedrooms and no sexual relations, subject to reconciliation provisions. Ask what evidence fits your actual ground.

Delaware Code, Title 13, 1503 and 1505

Timing: what starts the clock

Generally, six months of separation is needed before the divorce ruling, not before filing.

Once jurisdiction and separation requirements permit filing, the case can begin sooner. The misconduct ground has no fixed separation period, but requires proof. Do not confuse this clock with six months of residence.

Delaware Code, Title 13, 1503 and 1507

Property & debts

Marital property is divided equitably; jointly titled premarital real estate can be included.

That real-estate rule is an important exception to a simple before-marriage checklist. Bring deeds, acquisition records, agreements, and debts to a lawyer before assuming the house stays outside the settlement.

Delaware Code, Title 13, 1513

Spousal support

Alimony depends on dependency; a marriage of at least 20 years removes the eligibility time limit.

For shorter marriages, eligibility generally cannot exceed half the marriage term. The longer-marriage exception is not a guaranteed lifetime award. Ask about need, earning ability, and the consequences of a waiver.

Delaware Code, Title 13, 1512

Parenting & child support

Legal custody and residence are decided in the child's best interests.

A joint decision-making label does not specify a daily schedule. Review school continuity, exchanges, travel, support, and safety concerns separately before agreeing to arrangements that look simple on paper.

Delaware Code, Title 13, 722 and 728

Agreed & simpler processes

An uncontested petition can be decided on papers or at a hearing.

Different filing requirements apply. Uncontested marital status does not itself show agreement about every financial issue. Ask a lawyer to check the requested relief and deadlines before relying on a document-only route.

Delaware Family Court: uncontested procedures

Help while a case is pending

Preliminary restrictions and requested interim orders can protect finances and family arrangements.

Ask about the injunction's effective date and the evidence needed for temporary relief. A plan consultation is not necessarily payment for motion drafting or representation; confirm hearing coverage when asking for help.

Delaware Code, Title 13, 1509

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Forms and local filing

The statewide forms collection labels documents by court. Family Court also publishes filing instructions and copy requirements. Do not assume a Justice of the Peace form or procedure applies in Family Court, or that downloading a document files it. Forms collection · Family Court filing information.

Legal aid and finding a lawyer

The courts list Community Legal Aid Society, Delaware Volunteer Legal Services, and Legal Services Corporation of Delaware, with different service descriptions. The Legal Help Link is a screening and referral route. A consultation can be separate from hiring a lawyer for the entire matter; ask about its fee in advance. Before paying for a plan or service

Will the provider assign an attorney for the particular Delaware court and issue? Does a consultation lead to document review or representation, and what new agreement or charge applies if more work is needed?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Fees and filing requirements differ by court. The Justice of the Peace Court publishes its own application and financial affidavit to request relief from fees and costs; confirm the appropriate application for your court rather than reusing it everywhere. Budget attorney charges separately. Court-specific fee resources · Justice of the Peace fee-relief application (PDF).

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
