Before you rely on a plan

A state rule does not tell you whether a plan covers your issue. Check the product, effective date, existing-matter rules, lawyer network, and extra costs.

A detail worth knowing

Florida has a simplified-dissolution form with its own instructions and requirements. Agreement between spouses alone does not establish eligibility; read the form instructions before choosing that process. Source and current instructions.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Florida. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

$8,000 or less, excluding costs, interest, and attorney fees.

Local forms and practice can differ by county. Winning does not make the court collect the money for you; collection can be a separate task.

Florida Courts: small claims

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

15 days with no claim; 30 days for notice of an intended deduction.

These clocks run after the rental agreement ends and the premises are vacated. A tenant has 15 days after receiving the claim notice to object; notice and balance-payment requirements are separate.

Florida Statutes section 83.49

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Two attesting witnesses; witnesses sign with the testator and each other present.

The testator signs at the end or acknowledges the signature in the witnesses' presence. Do not assume the Texas handwritten-will exception transfers to Florida; electronic wills have separate procedures.

Florida Statutes section 732.502

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Planning follow-through: After a move, will a Florida lawyer review my old will rather than assume its signing method still works? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details

Florida: the important distinctions

Reviewed October 10, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

One spouse must have resided in Florida for 6 months before filing.

Proof of residence and the correct court still matter. Residence for divorce does not automatically decide jurisdiction over children or every financial issue.

Florida Statutes 61.021

Grounds & separation

Irretrievable breakdown is a divorce ground.

The statute also provides a mental-incapacity ground with a three-year condition. That is not a three-year separation requirement for ordinary no-fault divorce.

Florida Statutes 61.052

Timing: what starts the clock

Usually at least 20 days from filing the original petition to final judgment.

A court may act earlier if delay would cause injustice. This minimum is not a prediction of completion: service, unresolved issues, hearings, and the court calendar can extend the case.

Florida Statutes 61.19

Property & debts

Equitable distribution starts with equal division of marital assets and liabilities.

Relevant statutory factors may justify an unequal distribution. Nonmarital assets and liabilities are set apart; classification and agreements can materially affect the result.

Florida Statutes 61.075

Spousal support

Support requires actual need and ability to pay.

Current statutory types include temporary, bridge-the-gap, rehabilitative, and durational alimony. Marriage duration and other factors matter. Do not rely on older descriptions of permanent alimony.

Florida Statutes 61.08

Parenting & child support

Equal time-sharing has a rebuttable presumption, not a guaranteed outcome.

The child's best interests remain central. Evidence can rebut the presumption; domestic violence and safety must be considered. Parenting responsibility and guideline child support are related but distinct issues.

Florida Statutes 61.13

Agreed & simpler processes

Simplified dissolution is only for couples meeting every condition.

The official form requires agreement, no qualifying minor/dependent children or pregnancy, no alimony request, both signatures and attendance at the final hearing, and waiver of trial and appeal rights. Read the complete checklist before choosing it.

Help while a case is pending

Temporary alimony and suit money can be requested during the case.

Ask the local court or legal aid about temporary parenting needs and a separate protective-injunction process if safety is a concern. A final-divorce waiting period is not a reason to postpone urgent help.

Florida Statutes 61.071

Minimum legal periods are not completion estimates. See the timing explanation above before planning around a date.

Divorce information in Florida

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Florida. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Compare the kind of help you need

Court information
Use forms, instructions, and local court resources to understand the process.
Document preparation
Ask what is prepared, what you must complete yourself, and whether local forms are included.
Attorney review or advice
Ask whether a licensed attorney reviews your facts and documents, and what that service costs.
Representation
Confirm whether the engagement includes negotiation, hearings, or the entire matter. A consultation alone does not establish that scope.

Questions for the court and provider

For the court or self-help resource: Which dissolution process fits my facts, and what does the local clerk require?

For the plan: Is my specific issue covered in Florida? What effective-date, existing-matter, network, and extra-cost rules apply?

Ask a document service which form set it prepares and whether it checks suitability for the process you select.

Build a realistic budget

Separate the service price from court costs and any additional work. Ask whether a fee-waiver procedure is relevant. Use the cost calculator with an actual quote and the payments you still owe.

For civil legal-aid options, the Legal Services Corporation locator can identify nearby funded organizations. Each organization determines eligibility and available assistance.
