A detail worth knowing

Georgia's civil legal-aid starting points are geographically divided. The Child Support Commission lists Atlanta Legal Aid for Clayton, Cobb, DeKalb, Fulton, and Gwinnett counties and Georgia Legal Services Program for the other 154 counties. Contact the relevant organization for intake; location alone does not establish eligibility or available representation. Source: Commission assistance directory.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Georgia. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

$15,000 now; the magistrate civil limit increases to $25,000 on January 1, 2027.

The court's HB999 notice distinguishes the enacted change from its effective date. Check the limit in effect when filing, along with venue and eligible claim type; the future limit does not apply early.

Athens-Clarke Magistrate Court: HB999 effective date

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Generally 30 days after the lease ends or the tenant leaves, whichever is later.

The state handbook describes refund and damage-statement requirements. Formal move-out inspection rules depend on ownership and management arrangements; review disputed charges before signing an inspection list.

Georgia DCA landlord-tenant handbook, pages 15-17

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

A signed will needs two witnesses; notarization alone is not the substitute.

Georgia's official guide says both witnesses also sign and recommends witnesses who are not beneficiaries. Ask your lawyer about the execution ceremony and any separate self-proving paperwork.

Georgia.gov: write a will

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwriting does not waive Georgia's ordinary witness requirements. A handwritten will made under Georgia's rules still needs the required witnesses. Do not treat an unwitnessed note as the same thing as a properly executed will; ask separately about a will signed elsewhere.

University of Georgia Extension: handwritten wills

Spouse shares with children, but receives at least one-third. The spouse and children share equally unless that would leave the spouse less than one-third. Descendants of a deceased child can take that child's share. This concerns the distributable intestate estate, not every jointly held account; minor heirs may require separate arrangements.

Houston County Probate Court: distributions to heirs

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Can an included will address who manages a child's inheritance, and what would a trust or more customized drafting cost extra? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details

Georgia: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

The ordinary jurisdiction rule requires one spouse to have lived in Georgia for the past six months.

Venue is usually the respondent's county, with other routes in specified circumstances. A court able to end the marriage may not have authority over every financial issue; ask about jurisdiction and service before filing.

Georgia judiciary: divorce jurisdiction and venue instructions

Grounds & separation

An irretrievably broken marriage is an available no-fault ground; one spouse can say the marriage cannot be repaired.

The reason for ending the marriage does not settle money or parenting disputes. A plan consultation can identify the issues requiring individual review rather than treating a no-fault form as a complete settlement.

Timing: what starts the clock

With both parties' written consent, a hearing may occur after 31 days from service or filing the acknowledgment of service.

This is not a promise of divorce 31 days after filing the complaint. Other service and response routes have different timing; unresolved issues and court scheduling can extend the case.

Georgia Uniform Superior Court Rule 24.6

Property & debts

Marital property is divided equitably, not necessarily equally.

Identify every asset and describe property transfers precisely: an omitted parcel may remain in the existing owners' names. Ask a lawyer to review deeds, classification, balances, and the settlement's actual transfer language.

Georgia Supreme Court: Messaadi v. Messaadi, reproduced opinion

Spousal support

Alimony depends on need and ability to pay; the claimant's adultery or desertion causing the separation can bar it.

That is not a blanket rule that any allegation of an affair decides support. Bring financial records and ask for individual advice on cause, evidence, and the plan's coverage for negotiating or litigating support.

Georgia Code 19-6-1 (official publisher), rechecked October 16, 2026

Parenting & child support

The judge applies the child's best interests without a presumption favoring either parent or a particular custody form.

Joint custody is possible, not guaranteed. Family-violence findings make the child's and victim parent's safety primary; ask about decision-making, a workable schedule, and any protective measures rather than assuming equal time.

Georgia Code 19-9-3 (official publisher), rechecked October 16, 2026

Agreed & simpler processes

An agreed case still needs properly executed written consent, required papers, and a court decree.

Rule 24.3 addresses witnessed consent or counsel's consent; Rule 24.7 requires contested issues to be resolved before the decree. Ask a plan lawyer to review the agreement and applicable local requirements before signing.

Georgia Uniform Superior Court Rules 24.3 and 24.7

Help while a case is pending

Either spouse can request temporary alimony, including justified litigation expenses, while the case is pending.

The judge considers the parties' circumstances and resources; relief is not automatic. Ask about the petition, hearing, financial evidence, and whether court work or urgent representation is outside the plan's consultation benefit.

Georgia Code 19-6-3 (official publisher), rechecked October 16, 2026

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Legal aid and finding a lawyer

GeorgiaLegalAid provides public legal information from Atlanta Legal Aid and Georgia Legal Services Program. For private help, the State Bar offers a practice-area directory and links to referral options, but says it does not directly refer clients. A directory listing is not a prepaid network confirmation. Before paying for a plan or service

Does the service include the forms required by my county and the current child-support materials, if relevant? Who reviews any agreement and handles a disputed issue?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Ask the local clerk for the applicable filing and service costs and whether a procedure for people unable to pay is available. Obtain instructions for the particular court rather than rely on a statewide price estimate.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
