A detail worth knowing

The judiciary distinguishes Access to Justice Rooms, where volunteers offer limited legal advice, from Self-Help Centers, which provide limited information about forms and procedure. Assistance is not automatically full representation. Local descriptions and appointment arrangements should be checked before visiting. Source: descriptions of assistance.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Hawaii. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Generally $5,000; residential deposit-return claims have no monetary limit.

The Judiciary distinguishes a tenant's deposit-return case from a landlord's claim for back rent or damage. Attorney representation is barred in deposit disputes in this forum. A prepaid consultation may help you prepare, but it cannot turn that hearing into attorney-led representation.

Hawaii Judiciary: small claims, questions 1 and 13

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Generally 14 days after the rental agreement ends.

A deduction notice needs reasons and written cost evidence, such as estimates, invoices, or receipts, along with the remaining deposit. Supply a mailing address and keep move-out evidence. Wrongfully quitting the dwelling has a separate rule; do not assume moving out early leaves the ordinary refund process unchanged.

Hawaii Revised Statutes section 521-44(c)-(d)

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary written wills need two witnesses; qualifying handwritten wills have an exception.

Witnesses sign within a reasonable time after observing signing or the maker's acknowledgment. The handwritten exception requires the signature and material portions in the maker's handwriting. Signing a typed template alone does not meet that exception; obtain instructions for the intended execution route.

Hawaii Revised Statutes section 560:2-502

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

A signature and material portions in the maker's handwriting can qualify without witnesses. This alternative does not replace thoughtful drafting or account coordination. Ask whether covered review can address unclear gifts, substitute beneficiaries, and children who need someone to manage an inheritance.

Hawaii Revised Statutes 560:2-502: holographic wills

All-shared descendants can mean all; blended families use different initial amounts plus half. All goes to the spouse or reciprocal beneficiary only if neither has other surviving descendants. If only the survivor has others: first $330,000 plus half the balance; if the deceased has nonshared descendants: first $220,000 plus half. These are intestate-estate rules, not all household wealth.

Hawaii Revised Statutes 560:2-102

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will my plan lawyer coordinate spouse or reciprocal-beneficiary rights, children's provisions, and account beneficiaries, and identify any trust or specialized drafting that is separately charged? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details and state comparison

Divorce law details

Hawaii: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Generally, six months in Hawaii and three months in the filing circuit are required.

The Judiciary describes state domicile or physical presence and a separate circuit requirement for the filer. Ask about jurisdiction over children and out-of-state finances before treating a recent move as enough.

Hawaii Judiciary: divorce residency

Grounds & separation

Irretrievable breakdown is a ground; the separate two-year separation grounds are alternatives.

Do not assume every couple must first live apart for two years. A spouse need not agree that divorce is desirable, but resolving money, parenting, and service requirements still takes the appropriate process.

Hawaii Revised Statutes 580-41

Timing: what starts the clock

An affidavit packet still needs judicial approval and a filed decree.

The Judiciary gives a usual six-to-ten-week review estimate after an uncontested packet is submitted for judge review. This is a processing estimate, not a statutory minimum or a promise from the original filing date; contested cases can take longer.

Hawaii Judiciary: decree and processing

Property & debts

The court can make just and equitable property and debt orders, not a universal equal split.

Its authority covers the parties' estate under the statutory framework. Ask for review of acquisition values, titles, debts, and the proposed net result before accepting a simple half-of-everything worksheet.

Hawaii Revised Statutes 580-47

Spousal support

Spousal support considers needs, resources, earning ability, and other circumstances.

Training-related support can address a realistic return to employment. It is not automatic income equalization. Ask a lawyer to assess the proposed term alongside your budget and property settlement before waiving support.

Hawaii Revised Statutes 580-47: maintenance

Parenting & child support

Best interests guide custody; a family-violence finding creates a rebuttable presumption.

The presumption concerns custody with the perpetrator, including joint custody. Disclose safety concerns before selecting a cooperative parenting template; decisions, residence, exchanges, and support need individual attention.

Hawaii Revised Statutes 571-46

Agreed & simpler processes

A full agreement can allow uncontested divorce by affidavit without a court appearance.

The judge must approve the forms. Use the packet for the correct circuit and family situation. Independent review can help test the agreement's consequences; forms alone do not show that each spouse understands the tradeoffs.

Hawaii Judiciary: uncontested divorce

Help while a case is pending

Temporary orders can address children, support, expenses, and marital debts.

Relief before the final decree may be important when bills or housing cannot wait. Ask which motion and financial evidence are needed, and whether your prepaid plan includes representation rather than only initial advice.

Hawaii Judiciary: temporary orders

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in Hawaii

Understand the local process

Hawaii Judiciary: divorce. Find information and forms for the appropriate judicial circuit.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Hawaii. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

The court-forms directory groups materials for the First, Second, Third, and Fifth Circuits, as well as statewide forms. Choose the applicable circuit and court, read the instructions, and confirm current filing arrangements. A form for a different island or court may not be the right starting point. Source: forms directory.

Legal aid and finding a lawyer

The judiciary's assistance page lists local volunteer services and points qualifying users toward Legal Aid and Hawaii Online Pro Bono. Ask about eligibility, current appointments, the issue covered, and whether the assistance is advice or procedural information. Avoid assuming that an online answer includes later court appearances. Source: local and online legal-help routes.

Before paying for a plan or service

Is a Hawaii attorney available for your island, court, and legal issue? If assistance is remote, does the provider handle local filing and appearances, and are travel or additional attorney charges separate?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

The judiciary notes that fees in certain non-criminal matters may be waived for people meeting financial criteria. Ask your court about the relevant request, supporting information, and decision. Compare filing, service, and any travel expenses separately from subscription dues and attorney fees. Source: court forms and fee-relief notice.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
