What brings you here?

Before you rely on a plan

A state rule does not tell you whether a plan covers your issue. Check the product, effective date, existing-matter rules, lawyer network, and extra costs.

A detail worth knowing

The statewide forms collection includes divorce, child support, maintenance, and fee-waiver categories. Having a form available does not establish that the form fits every case. Source and current instructions.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Illinois. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $10,000 for tort or contract money claims, excluding interest and costs.

A simplified case still needs the proper parties, service, evidence, and local procedure. The amount alone does not establish that the claim is suitable.

Illinois Supreme Court Rule 281

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Property-damage itemization has a 30-day clock; missing required documentation can trigger full return within 45 days.

The itemization clock runs from vacating or the end of possession rights, whichever is later. The Act includes receipt and estimate rules. Local protections may also matter; do not reduce every deposit dispute to a single 45-day rule.

Illinois Security Deposit Return Act

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills require two or more credible witnesses in the testator's presence.

A will must be written and signed by the testator or an authorized signer in the testator's presence and at their direction. Electronic and remote-witness procedures are separate; a template alone does not complete execution.

Probate Act section 4-3

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwriting alone does not remove ordinary attestation requirements. Under the ordinary Illinois execution rule, a handwritten document still needs the required signature and witnesses. This row is not a determination of whether an old will made under another state's law is valid.

755 ILCS 5/4-3: ordinary execution

Half to the spouse and half to descendants. With both a spouse and descendants surviving, the intestate estate is split equally between those groups after valid claims are paid. Descendants take by family branch (per stirpes); marriage alone does not mean the spouse receives all.

755 ILCS 5/2-1(a)

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will a plan attorney explain the spouse-and-child split and help coordinate a will with existing beneficiary designations? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Illinois: the important distinctions

Reviewed October 10, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

A 90-day residence condition must be met before the divorce can be granted.

The statutory period can precede filing or the court's finding. Filing before 90 days can be possible; military presence is another statutory route. Check venue and other jurisdiction issues separately.

Grounds & separation

Irreconcilable differences are the ground; 6 months apart establishes a presumption.

Six continuous months apart before judgment creates an irrebuttable presumption of the ground. It is not a universal prerequisite when the ground can otherwise be established.

750 ILCS 5/401

Timing: what starts the clock

Do not read the 6-month separation presumption as a post-filing wait.

The 90-day residence condition, establishing the ground, resolving issues, notice, and the court's process all matter. An agreed case still needs a judge's approval; there is no promised completion date here.

Illinois Legal Aid Online: divorce FAQ

Property & debts

Marital property and debts are divided equitably, not automatically 50/50.

Relevant factors include contributions, economic circumstances, duration, needs, and agreements. Identify marital versus nonmarital property and potential reimbursement questions before settling.

Illinois Legal Aid Online: property and debt

Spousal support

A judge first considers whether maintenance is appropriate.

Guidelines apply to qualifying circumstances; other cases use statutory factors. Income, earning capacity, marriage duration, and needs matter. A guideline calculation is not automatic eligibility.

Illinois Legal Aid Online: maintenance

Parenting & child support

Parental responsibilities and parenting time need a child-focused plan.

Decision-making, time with each parent, and child support are separate questions to resolve. Use the correct court resources and address safety or existing orders before negotiating a plan.

Illinois Legal Aid Online: parental responsibilities

Agreed & simpler processes

Agreed divorce and joint simplified divorce are different processes.

Joint simplified divorce has strict eligibility, including no children, financial limits, and other conditions. The linked form tool is for Cook County only; confirm your own county's forms and procedures.

Help while a case is pending

Standing orders, temporary orders, and financial disclosure deserve an early check.

Ask about immediate parenting or household-payment needs, local standing orders, and the correct protective-order route if needed. Do not assume an informal agreement replaces a court order.

Illinois Legal Aid Online: during a divorce

Minimum legal periods are not completion estimates. See the timing explanation above before planning around a date.

Divorce information in Illinois

Understand the local process

Illinois Courts: divorce, support, and maintenance forms. Statewide forms include instructions; local filing procedures still matter.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Illinois. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Compare the kind of help you need

Court information
Use forms, instructions, and local court resources to understand the process.
Document preparation
Ask what is prepared, what you must complete yourself, and whether local forms are included.
Attorney review or advice
Ask whether a licensed attorney reviews your facts and documents, and what that service costs.
Representation
Confirm whether the engagement includes negotiation, hearings, or the entire matter. A consultation alone does not establish that scope.

Questions for the court and provider

For the court or self-help resource: Which form set should I use, and where can I find the local filing instructions?

For the plan: Is my specific issue covered in Illinois? What effective-date, existing-matter, network, and extra-cost rules apply?

Compare a paid document service with the available court instructions, then decide whether you need attorney advice or review as well.

Build a realistic budget

Separate the service price from court costs and any additional work. Ask whether a fee-waiver procedure is relevant. Use the cost calculator with an actual quote and the payments you still owe.

For civil legal-aid options, the Legal Services Corporation locator can identify nearby funded organizations. Each organization determines eligibility and available assistance.
