Civil legal aid and court self-help

Find local civil legal aid. Ask the program about eligibility, issue limits, available help, and response time. Applying is not acceptance or an agreement to represent you.

Court self-help information explains procedures; it does not establish attorney representation.

A detail worth knowing

Indiana's judiciary explains that court and clerk staff cannot give legal advice even if a staff member is licensed to practice law: they must remain neutral. The getting-legal-help page instead links to lawyer directories and online question services. Source: court staff and legal advice.

Legal help beyond divorce

Protect your home, money, and plans

Four sourced distinctions for Indiana. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Eligible claims of $10,000 or less; reducing a larger claim gives up the excess.

The 2026 court manual covers money, property damage, and other eligible disputes. Filing in small claims waives the amount above its limit, which cannot be sued for later. Foreclosure and possession under a land contract require a different civil procedure; the dollar amount alone does not decide eligibility.

Indiana Judicial Branch: 2026 Small Claims Manual, pages 11-12 and 15

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

45 days after the rental agreement ends and possession is delivered; give your mailing address in writing.

The landlord is not liable under this chapter until you supply that written address. Deductions must be itemized with the remaining amount. Record both the termination and possession-return dates, and keep proof of the address notice rather than counting only from the day you packed.

Indiana Code section 32-31-3-12

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills need the maker's signature and at least two witnesses signing in each other's and the maker's presence.

The maker declares the document is a will and signs or acknowledges it. Presence can include compliant real-time audiovisual interaction; separate paper counterparts require attorney or directed-paralegal supervision and additional safeguards. Electronic wills have their own chapter. Ask which signing procedure your provider actually supports.

Indiana Code sections 29-1-5-3 and 29-1-1-3(16)

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwriting alone does not waive the ordinary witnesses. Indiana's written-will rule requires your signature and at least two witnesses. A wholly handwritten note is not a general exception. Recognition of a document made elsewhere is a separate question.

Indiana Code 29-1-5-3: written wills

Generally half to the spouse; a qualifying subsequent-spouse case treats land differently. With surviving descendants, the ordinary spouse share is half the net estate. A second or later spouse who never had children with the deceased, where descendants from a previous spouse survive, instead gets half the personal property and an amount equal to 25% of the deceased's land value after liens. Do not treat that amount as a quarter ownership interest in the land.

Indiana Code 29-1-2-1(b)-(c)

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Can the covered lawyer review remarriage, children from an earlier marriage, and the house title before deciding whether a simple will meets our wishes? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Indiana: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Usually six months in Indiana and three months in the filing county.

At least one spouse must meet the residence or qualifying military-stationing periods immediately before filing. A guardian-filing exception exists. Money and child-custody jurisdiction need separate review.

Indiana Code 31-15-2-6

Grounds & separation

Irretrievable breakdown is available without proving marital misconduct.

Other statutory grounds exist, but the no-fault ground does not require a year living apart. Legal separation and dissolution have different effects; choose the process for the outcome you need.

Indiana Code 31-15-2-3

Timing: what starts the clock

The ordinary final hearing cannot occur earlier than 60 days after filing.

The filing date starts this minimum, not the date you moved out. An agreed summary decree also requires at least 60 days. Service, unresolved issues, and scheduling can make the case longer.

Indiana Code 31-15-2-10 and 31-15-2-13

Property & debts

Equal division is presumed, but property owned before marriage is not automatically outside the case.

The court's property pool includes premarital property. Evidence about gifts, inheritance, contributions, finances, or dissipation can rebut an equal split. Bring ownership and debt records rather than assuming whose name is on an account decides the result.

Indiana Code 31-15-7-4 and 31-15-7-5

Spousal support

Court-ordered maintenance has specific incapacity, caregiving, and rehabilitation routes.

A pay difference alone is not the full test. Rehabilitative maintenance can last no more than three years from the final decree; incapacity and qualifying caregiving have different rules. Review any negotiated support promise before signing.

Indiana Code 31-15-7-2

Parenting & child support

Best interests guide custody, with no presumption favoring either parent.

The child's adjustment, relationships, health, and a pattern of family violence matter. More consideration goes to a child's wishes at age 14 or older, but the child does not simply choose. Child support requires a separate calculation.

Indiana Code 31-17-2-8

Agreed & simpler processes

A summary decree without a final hearing can be available when both spouses file verified agreement documents.

Both must sign a hearing waiver and either confirm no contested issues or submit a settlement resolving them. The court may grant this route after the minimum wait; a downloaded agreement alone does not end the marriage.

Indiana Code 31-15-2-13

Help while a case is pending

Temporary orders can address support, custody, property possession, and restraints.

The final-hearing wait does not mean every immediate need must wait. Ask about the required request and evidence for housing, bills, or parenting. Urgent safety help and plan enrollment are separate routes.

Indiana Code 31-15-4-8

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Indiana. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

Indiana Legal Help's common forms include continuance, appearance, fee-waiver, and virtual-hearing materials, with separate family filing-fee waiver downloads. Read the matching instructions and confirm filing arrangements with your local clerk. Filling out a request does not mean that a hearing has moved or that an appearance by video has been approved. Legal aid and finding a lawyer

Indiana Legal Help allows a search by county or ZIP code for organizations, services, and legal clinics. The judiciary's getting-legal-help page also lists private lawyer-finding and free legal-question resources. Confirm eligibility, issue coverage, and whether the help includes representation; access to information is not acceptance of your case. Before paying for a plan or service

Does the plan attorney handle the local court work, or only answer an initial question? If a document service supplies forms, who reviews the legal choices and handles service, negotiations, or a hearing?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Indiana Legal Help explains that a filing-fee waiver asks the court not to charge a filing fee when qualifying requirements are met. Its fee FAQ also distinguishes filing from sheriff service and says fees generally apply when a case starts, rather than every time a document is filed. Confirm the current fee for your case and the scope of any relief instead of treating a commercial package price as the entire cost. Source: filing-fee FAQ.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
