A detail worth knowing

Kentucky's legal self-help page says completing a guided interview produces a form that the user still needs to print and file with the Circuit Court Clerk in the county handling the case. Finishing an online questionnaire is not the same as filing a case. Source: guided forms and filing.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Kentucky. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Small claims covers $2,500 or less, not District Court's broader $5,000 civil limit.

Those are different routes within the same court. A $4,000 dispute does not become a small claim just because District Court can hear it. Ask the clerk or your lawyer about the appropriate procedure before reducing a claim or selecting forms.

Kentucky Court of Justice: District Court jurisdiction

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Local adoption matters; inspection lists can affect your ability to challenge charges.

First confirm whether your locality adopted the Uniform Residential Landlord and Tenant Act. Where it applies, inspect the damage lists and specifically dispute incorrect items in a signed written statement. When a refund is due and no rent is owed, respond promptly to the refund notice: 60 days runs from sending, not receipt. This is not a statewide 30-day refund rule.

Kentucky KRS 383.500 and 383.580: local adoption and deposits

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Typed wills need at least two credible witnesses signing with the maker and each other present.

The maker signs or acknowledges the will before those witnesses, who then sign in the maker's presence and each other's. A will wholly written and signed by its maker has a separate witness exception; filling in a typed form is not that exception. Check the ceremony as well as the wording.

Kentucky KRS 394.040: will execution

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

A wholly handwritten, signed will can dispense with attesting witnesses. This is a narrow alternative, not permission to sign an unwitnessed printed template. Clear intent, suitable terms, and later proof still matter. A covered lawyer can help prevent informal wording from becoming a family dispute.

Kentucky KRS 394.040: wholly handwritten exception

Spouse gets half of surplus personalty; real estate has separate 2026 rules. Since July 15, 2026, the personal-property calculation can include beneficiary accounts, survivorship transfers, and revocable-trust property, with credits and exceptions. Real-estate descent is separately governed by KRS 391.010. Do not assume a beneficiary designation bypasses every spouse protection.

Kentucky KRS 392.020: effective July 15, 2026

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Does the lawyer's review account for Kentucky's July 2026 spouse rights across beneficiary accounts, trusts, and real estate, or is the benefit only a basic will? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details

Kentucky: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

One spouse needs 180 days of residence or qualifying military stationing.

The period must immediately precede filing. Authority over support, property, and children still needs individual review; satisfying residence does not answer every interstate question.

Kentucky KRS 403.140

Grounds & separation

Irretrievable breakdown requires at least 60 days living apart before decree.

Living apart can include sharing a roof without sexual cohabitation. This is not the same clock as service or a children's-case hearing restriction. Ask how to document the applicable dates.

Kentucky KRS 403.170

Timing: what starts the clock

Cases with minor children have a separate 60-day hearing restriction.

Except temporary motions, testimony waits 60 days from the earliest service, warning-order attorney appointment, appearance, or responsive pleading. It is not simply 60 days after filing and is separate from living apart.

Kentucky KRS 403.044

Property & debts

Separate property is assigned; marital property is divided in just proportions.

The division disregards marital misconduct and recognizes homemaking. Gifts, inheritances, and marital contributions need classification. A half-and-half spreadsheet is not a substitute for reviewing the proposed division.

Kentucky KRS 403.190

Spousal support

Maintenance requires both insufficient property and a qualifying inability to meet needs.

Suitable employment and certain childcare responsibilities matter, followed by amount-and-duration factors. An income gap alone does not establish eligibility. Bring a realistic post-separation budget to a covered consultation.

Kentucky KRS 403.200

Parenting & child support

Joint custody and equal parenting time presumptions yield to abuse protections.

A domestic-violence order removes the usual presumption for that party. Since July 15, 2026, a finding of two or more domestic-violence acts creates a presumption against joint custody and equal time, with further safety restrictions.

Kentucky KRS 403.315: effective July 15, 2026

Agreed & simpler processes

A written separation agreement gets different review for money and children.

Financial terms generally bind unless unconscionable; parenting and support do not simply bind the judge in the same way. Ask about enforceability and future modification before trading an important right for a quick agreement.

Kentucky KRS 403.180

Help while a case is pending

Temporary motions can seek maintenance, child support, and protective restraints.

Financial requests require supporting facts, including an affidavit. Interim proceedings can address immediate needs before final divorce, but a plan consultation is not a promise that emergency litigation is included.

Kentucky KRS 403.160

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Legal aid and finding a lawyer

The judiciary lists four civil legal-aid programs with the regions and counties they serve. Start with the program serving your location, then ask about eligibility, capacity, and whether available help is advice or representation. A referral or guide is not a promise that a provider will take the case. Source: regional programs.

Before paying for a plan or service

Does the service only create documents, or will a Kentucky attorney review the legal choices and handle the filing and hearing work? If public guided forms cover part of the task, what additional help does the paid option include?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Kentucky's AOC-026 combines a civil motion for waiver of costs and fees, a sworn financial statement, and an order that can grant or deny relief. It asks about income, expenses, assets, and debts. Confirm its applicability and the court's decision; submitting financial information alone is not approval or proof of commercial plan coverage. Source: AOC-026 motion and order (PDF).

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
