A detail worth knowing

The Navigator describes its In Forma Pauperis tool as a request to delay filing fees when the applicant cannot afford them at the start of a case. Preparing that request does not establish that all court costs are permanently erased. Confirm the court's decision and any later obligations. Source: fee-delayer purpose.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Louisiana. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Small-claims divisions can hear disputes up to $5,000, excluding specified extras.

The limit excludes interest, court costs, attorney fees, and penalties. This procedure cannot issue an ordinary injunction or restraining order, and it prohibits class actions. A request to stop conduct may need a different court route even when the money involved is modest.

Louisiana R.S. 13:5202: small-claims jurisdiction

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Refunds have a one-month rule; the deductions statement has a separate extended deadline.

Current law permits the itemized statement within one month after termination or within 15 days after that one-month date. Do not turn that accounting extension into extra refund time or assume a month means 30 days. Give a forwarding address at termination; the statute excludes specified abandonment situations.

Louisiana R.S. 9:3251, including 2026 Act 63

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

A notarial will needs writing, a date, a notary, two witnesses, and all required signatures.

The current article requires execution before the notary with two witnesses and signatures by the maker, both witnesses, and notary. Louisiana changed these formalities in 2025; handwritten wills and self-proving paperwork follow separate provisions. Ask a Louisiana lawyer to check the current procedure rather than relying on an older template.

Louisiana Civil Code article 1576, amended by 2025 Act 30

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

An olographic will is entirely handwritten, dated, and signed by its maker; witnesses are not a form requirement. Current law addresses signature and date placement and later handwritten changes. A typed document with a handwritten signature is different. Ask the plan lawyer to review an existing note and its intended gifts.

Louisiana Civil Code 1575, amended by Acts 2025, No. 30

With descendants, the survivor ordinarily has a usufruct over the deceased spouse's undisposed community share, ending at death or remarriage. This right to use and benefit from property is different from outright ownership. Ask a Louisiana lawyer to explain the children's ownership, separate versus community assets, and how a will changes the default before relying on a percentage.

Louisiana Civil Code 890; descendant succession in Article 888

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will my plan lawyer check community-property ownership and beneficiary accounts, explain usufruct and any forced-heir issues, arrange current Louisiana signing formalities, and quote specialized succession or trust work separately? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Louisiana: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

At least one spouse must be domiciled in Louisiana when the divorce is filed.

Six months of residence in a parish creates a rebuttable presumption of domicile, not an absolute six-month filing requirement. Ask a lawyer to check domicile, parish venue, service, and separate jurisdiction over children.

Louisiana Code of Civil Procedure 10(A)(7), (B)

Grounds & separation

Ordinary no-fault divorce uses continuous separation; other grounds include adultery and specified abuse-related grounds.

Article 103(1) uses separation completed before filing; Article 102 follows a different procedure. Covenant marriages have different rules. Ask which route fits the facts before paying for an online packet.

Louisiana Civil Code 103

Timing: what starts the clock

The ordinary separation period is 180 days without minor children of the marriage, or 365 days with them.

Article 102 also measures a delay from service or written waiver before the final motion. This is not simply a countdown from filing. Ask an attorney to check dates and proof; court processing can add time.

Louisiana Civil Code 103.1; see also Article 102

Property & debts

A court partition divides community assets and liabilities to equal net values, not necessarily half of each item.

An equalizing payment may be needed; assigning a debt between spouses does not change a creditor's rights. Bring valuations and debt records and ask whether partition, retirement orders, and reimbursement disputes cost extra.

Louisiana Revised Statutes 9:2801(A)(4)

Spousal support

Final periodic support generally requires need, ability to pay, and absence of qualifying pre-filing fault.

Income, obligations, earning capacity, marriage length, and abuse matter; certain grounds create a presumption of entitlement. This differs from interim support. Ask a lawyer to assess eligibility and negotiation, not just a standard form.

Louisiana Civil Code 112

Parenting & child support

Best interests govern parenting; abuse is a primary consideration and special safety rules apply.

Joint custody is not a guarantee of equal time or safe negotiation. Ask for individual advice on decision-making, the practical schedule, and protective measures before agreeing to a parenting plan.

Louisiana Civil Code 134; see also Article 132

Agreed & simpler processes

Agreement does not replace the evidence and service requirements for an Article 102 divorce.

The statute lists the petition, service or waivers, final motion, and affidavits establishing continuous separation. Ask who prepares and checks the final papers; a signed settlement alone does not end the marriage.

Louisiana Code of Civil Procedure 3956

Help while a case is pending

During divorce, either spouse may request parenting, support, injunctive relief, and use of the family home or property.

These are matters the court may determine, not automatic protection from filing. Ask a lawyer about urgent requests, evidence, and whether motions and appearances are included or separately charged.

Louisiana Civil Code 105

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Before paying for a plan or service

Is the attorney licensed for my Louisiana matter and available for work in the relevant court? Does the quoted benefit include advice, document review, negotiations, and appearances, or only forms?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

The fee-delayer interview requests detailed financial information, including income, expenses, assets, and support. It also describes third-party affidavit or legal-aid certification options. Review its current instructions and ask the court about the fees at issue. Keep any delayed costs, service expenses, and uncovered attorney work visible in the budget. Source: financial information and paperwork.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
