Before you rely on a plan

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Maryland. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $5,000, for money only and without planned discovery.

A request to return property or perform a service is not this small-claims procedure. Nor is a case where you need formal discovery to obtain the other side's records. Ask about the appropriate civil route before choosing forms; an eligible small claim may still use a lawyer.

Maryland Courts: the three small-claim eligibility tests

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Generally 45 days after tenancy ends; eviction or abandonment has a different notice procedure.

Keep your address and move-out records. The ordinary rule requires a refund less lawful deductions and a timely itemized damage list. Estimated repair charges require follow-up documentation; an overestimate must be refunded within 30 days after repairs finish. Certain evicted or abandoning tenants must first send the statutory address notice within 45 days after leaving.

Maryland Real Property section 8-203(e), (g)-(k)

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills need two credible witnesses; qualifying remote execution has extra safeguards.

Remote witnessing is permitted through specified attorney-supervised or maker-certified routes, not video alone. Both involve a certified paper will, identity and location requirements; the maker-certified route requires notarial acknowledgment. Ask which procedure the provider supports and who completes the certification.

Maryland Estates and Trusts section 4-102: execution and certification

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

The unwitnessed handwritten exception is limited to specified military circumstances. It concerns qualifying U.S. armed-services members outside U.S. states, D.C., and territories, with a post-discharge limit and exceptions. It is not a general option for residents who want to avoid witnesses.

Maryland Estates and Trusts 4-103

Minor child: half; nonshared descendants without minors: first $100,000 plus half the rest. Otherwise the spouse or registered domestic partner receives the entire intestate estate under this section. Shared adult descendants do not trigger the minor-child rule. Check children's ages, family relationships, and registered status rather than relying on older inheritance summaries.

Maryland Estates and Trusts 3-102: current text

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Can a covered lawyer check how our children's ages and registered relationship status affect defaults, then coordinate the will with beneficiary accounts and valid signing? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Maryland: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Six months of residence applies when the grounds arose outside Maryland.

Either party can satisfy that period before filing. Where the grounds arose matters; the rule is not an automatic six-month delay for every resident. Ask which court can address your family and finances.

Maryland Family Law 7-101

Grounds & separation

Three grounds: six-month separation, irreconcilable differences, or mutual consent.

Separate lives can qualify despite a shared roof. Mutual consent has its own agreement requirements. A spouse's refusal to sign does not mean the six-month separation route is the only possible option.

Maryland Family Law 7-103

Timing: what starts the clock

Irreconcilable differences has no waiting period before filing.

The six-month separation ground is a different route, not a mandatory delay for every divorce. Service, response, and court review still take time. No instant final judgment is promised by an online document service.

Maryland Judiciary: Divorce Basics (PDF)

Property & debts

A monetary award and specified transfers can adjust marital property interests.

The court uses statutory factors, not an automatic equal split. Ownership, debt, and the proposed award need review together. A settlement discussion should address the house and retirement interests as well as cash.

Maryland Family Law 8-205

Spousal support

Alimony considers self-support, training, need, and ability to pay.

Indefinite awards are possible in specified circumstances, including limited progress from age or illness, or an unconscionable disparity after expected progress. Indefinite is not a promise of lifetime payments. Review waivers against likely future needs.

Maryland Family Law 11-106

Parenting & child support

Best interests include safety, stability, and managing parental conflict.

Current statutory factors address a child's needs and each parent's involvement. Decision-making, residence, and practical transitions deserve separate attention. Disclose intimidation or abuse before treating cooperation as a safe default.

Maryland Family Law 9-201

Agreed & simpler processes

Mutual consent needs a complete signed agreement and children's-interest review.

Resolve alimony, property, and applicable child arrangements; a support worksheet is required when support is paid. Agreement to end the marriage is not agreement on every consequence. A covered review may be valuable before signatures.

Maryland Family Law 7-103(a)(3)

Help while a case is pending

Temporary alimony may be requested while the case is pending.

Interim support is distinct from the final award and is not automatic. Ask about financial evidence and whether your benefit includes presenting the request, not merely explaining it.

Maryland Family Law 11-102

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in Maryland

Understand the local process

Maryland Courts: divorce. Start with the court's guidance and self-help options.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Maryland. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

Use the judiciary's forms collection and confirm the instructions for your court and case type. If you need help understanding paperwork or the court process, ask a Court Help Center about its available assistance. Keep form completion, legal advice, and representation as separate items in any quote. Court forms · Help with documents.

Legal aid and finding a lawyer

Maryland's finding-legal-help page provides routes to free or lower-cost help and private attorneys. Confirm each organization's eligibility and services directly. Court Help Center assistance is limited and is not the same as an attorney taking responsibility for the entire case. Source: finding legal help.

Before paying for a plan or service

What work goes beyond the limited help available from a Court Help Center? Does my plan cover that additional work, including any negotiation or hearing, and are court costs excluded?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Maryland distinguishes waiver of prepaid costs from final waiver of open costs. Upfront relief can allow a filing to proceed without prepayment, but does not necessarily eliminate costs owed at the end. The court decides those requests at different stages. The instructions also require a Notice Regarding Restricted Information (MDJ-008) with the waiver request. Follow the current court instructions and any order issued. Source: upfront and final fee relief.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
