A detail worth knowing

Court Service Centers provide free assistance with certain case types, including basic questions, forms, and procedures. They provide legal information, not legal advice, and their assistance does not eliminate other case expenses such as filing fees. Check the current services and contact options before attending. Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Massachusetts. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Generally $7,000; motor-vehicle property damage has an amount-limit exception.

An automobile property-damage claim is different from an ordinary unpaid bill. A qualifying consumer-protection claim initially within the limit can also produce a higher award through double or triple damages. Do not assume every claim over $7,000 is excluded, or that these exceptions cover every car-related dispute.

Massachusetts Trial Court: small-claims limits and exceptions

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

30 days after the relevant tenancy endpoint; damage deductions need sworn supporting paperwork.

For a tenancy at will, the statute uses the end of occupancy; for a valid written lease, it uses the end of that tenancy. Moving early does not necessarily start the clock. Damage deductions require a detailed statement under penalties of perjury plus written estimates, bills, invoices, or receipts. Ordinary wear is excluded; qualifying short vacation rentals have a separate statutory exclusion.

Massachusetts General Laws chapter 186 section 15B(4), (9)

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

The ordinary written-will route requires the maker's signature and at least two witnesses.

Each witness must have witnessed signing or the maker's acknowledgment of the signature or will. A notary stamp alone does not supply that witnessing. Unlike some other states' statutes, this section does not provide a general unwitnessed-handwritten-will alternative; documents executed elsewhere need a separate validity check.

Massachusetts General Laws chapter 190B section 2-502

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

No general unwitnessed-handwritten alternative in the ordinary rule. Writing everything by hand does not remove the two-witness requirement. A will executed elsewhere needs a separate choice-of-law review; this row does not decide that document's validity.

Massachusetts G.L. c. 190B, 2-502: execution

All in the fully shared-family case; otherwise first $100,000 plus half the balance. All goes to the spouse if every surviving descendant of the deceased is shared and the survivor has no other surviving descendants. If either spouse has the specified nonshared descendants, the spouse gets the first $100,000 of the intestate estate plus half any balance. Beneficiary-designated accounts are a separate check.

Massachusetts G.L. c. 190B, 2-102(1), (3)-(4)

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will an included consultation check both spouses' children and account beneficiaries, and explain any separately priced trust work? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details

Massachusetts: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

One-year residence is a route when the cause occurred outside Massachusetts.

Another route requires domicile when filing and a cause occurring in Massachusetts. Moving solely to obtain a divorce can defeat that route. Ask about your facts, venue, and jurisdiction rather than treating the wedding location as controlling.

Massachusetts G.L. c. 208, 5

Grounds & separation

Irretrievable breakdown has joint (1A) and individual (1B) filing routes.

A 1B complaint does not require a spouse's signed dissolution agreement at filing. Its ordinary hearing wait is six months from the complaint, with a statutory consolidation exception. That is not a requirement to live apart for six months first.

Massachusetts G.L. c. 208, 1B

Timing: what starts the clock

Approval is not final divorce: the nisi period still matters.

In a joint 1A case, 30 days from initial agreement approval precede entry of the nisi judgment, then the 90-day nisi period runs. A 1B or fault divorce ordinarily becomes final 90 days after its nisi judgment. Do not plan remarriage on the hearing date.

Massachusetts Courts: finalizing a divorce; c. 208, 1A

Property & debts

The court can assign all or part of either spouse's estate, not just split new purchases.

Marriage length, conduct, contributions, needs, liabilities, and future opportunities matter. Premarital or inherited assets are not categorically outside the court's reach. Gather records before agreeing to an informal 'keep what is in your name' split.

Massachusetts G.L. c. 208, 34

Spousal support

Alimony form, amount, and duration depend on circumstances.

Need, income, employability, marriage length, and lost opportunities matter; child-support income treatment and deviations complicate any percentage shortcut. A generic calculator is not a promise of support or a substitute for reviewing a waiver.

Massachusetts G.L. c. 208, 53

Parenting & child support

Shared legal custody is not the same as shared physical time.

Temporary shared decision-making has emergency, abuse, and best-interest qualifications; it does not presume shared physical custody. At trial, no general shared-custody presumption applies, subject to the abuse provision. Support is a separate worksheet issue.

Massachusetts G.L. c. 208, 31 and linked 31A

Agreed & simpler processes

A joint 1A petition needs a separation agreement the court can approve.

Agreement must address applicable parenting, support, alimony, and property issues. Ask what it means for terms to merge into the judgment or survive as a separate contract; those choices can affect later enforcement or changes.

Massachusetts G.L. c. 208, 1A

Help while a case is pending

Temporary alimony and money to maintain or defend the case may be requested.

A court can order financial help while litigation is pending; it is not automatic fee reimbursement. Ask what financial records and motion are needed. Parenting or safety concerns may require additional requests before the final judgment.

Massachusetts G.L. c. 208, 17

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in Massachusetts

Understand the local process

Massachusetts: divorce information. Compare the court processes and their requirements.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Massachusetts. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

A service center can help users navigate paperwork within its supported case types. That is different from an attorney advising what claims to bring or how to protect disputed rights. Confirm which help is available, what forms and local filing steps are required, and what you must do after preparing the documents. Source: procedural assistance and limits.

Legal aid and finding a lawyer

MassLegalHelp's attorney-finding guide links to the Massachusetts Legal Resource Finder, private lawyer referral services, and limited assistance with part of a case. It cautions that not everyone qualifies for free legal aid and programs cannot accept every matter. Ask the relevant organization about eligibility and available help; a referral is not a guarantee of representation. Source: legal-help routes.

Before paying for a plan or service

Could a Court Service Center help with procedure while a separately retained attorney reviews the legal issues? What would a limited engagement or a plan cover, and what would remain outside it?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Massachusetts publishes eligibility information for indigency and court-fee relief. Review the applicable criteria and ask the clerk which paperwork and supporting information are required for your request. Treat court-fee relief and the price of any attorney engagement as separate questions. Source: fee-relief eligibility.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
