Before you rely on a plan

A state rule does not tell you whether a plan covers your issue. Check the product, effective date, existing-matter rules, lawyer network, and extra costs.

A detail worth knowing

The Commission distinguishes interactive tools that create forms from Mississippi Free Legal Answers, where qualifying users can ask civil legal questions of volunteer attorneys. Generating papers and receiving advice are different services; neither should be assumed to include ongoing representation. Source: forms and online legal questions.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Mississippi. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Justice Court handles eligible debts, damages, or personal property up to $3,500.

The principal debt, amount demanded, or property's value determines the limit. Justice Court does not have jurisdiction over Chancery Court matters, so a modest amount alone does not make every dispute eligible. Have a lawyer or clerk help identify the court before you pay to file.

Mississippi Judicial College: July 2026 Justice Court manual, section 401

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

45 days depends on tenancy termination, return of possession, and a tenant demand.

Do not count only from moving day. Make a documented demand, provide your address, and retain proof of key return. The landlord's written notice must itemize deductions; ordinary wear is excluded from damage charges, while qualifying cleaning or other necessary default expenses can also be charged.

Mississippi Judicial College: July 2026 manual, section 89-8-21, PDF page 118

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Typed wills need at least two credible witnesses attesting in the maker's presence.

Witnesses must know they are witnessing a will, not merely sign an unexplained document. A will wholly handwritten and signed by its maker has a separate exception; adding handwriting to a typed form is not that route. Ask the plan lawyer to explain the ceremony and appropriate witnesses.

Mississippi Judicial College: 2026 Chancery benchbook, section 91-5-1, PDF page 586

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

A wholly handwritten and signed will can qualify without execution witnesses. A typed form with only a handwritten signature is different. Later proof and clear intent still matter. Ask the plan lawyer to review an existing note rather than assume handwriting resolves every requirement.

Mississippi Bar: holographic wills

With surviving children or their descendants, the spouse generally receives a child's share of the intestate estate. It is not automatically the whole estate, including in a blended family. Descendants can represent a deceased child's branch. Ask the lawyer to check the family tree, home rights, debts, and assets passing by beneficiary designation.

Mississippi Code 91-1-7 (official publisher), rechecked October 16, 2026

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will my plan lawyer review the spouse-and-children inheritance default with my beneficiary accounts and home ownership, arrange witnesses, and quote any trust, tax, or probate work outside the will benefit? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Mississippi: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Ordinarily, either spouse needs six months of Mississippi residence before filing.

County venue and service also matter. Ask a lawyer to check the residence evidence and any military exception rather than assuming where you married determines where you can divorce.

Mississippi Bar: residence and filing

Grounds & separation

Irreconcilable-differences divorce requires both spouses' voluntary consent; it is not a unilateral no-fault route.

If consent is missing, a different statutory ground needs proof. A prepaid consultation can help assess the route and evidence; a document subscription cannot make the other spouse consent.

Mississippi Bar: divorce grounds

Timing: what starts the clock

An irreconcilable-differences complaint must be on file for 60 days before it is heard.

That is a minimum, not a promised completion date. The agreement or issues submitted to court, proper service, and scheduling still need attention. Ask who handles final submission and review.

Mississippi Bar: irreconcilable-differences waiting period

Property & debts

Marital property is divided equitably rather than necessarily equally, after classification and valuation.

Homemaking contributions matter; separate assets can change character through mixing or family use. Bring account and home records and ask whether valuation, retirement orders, and disputed tracing are included in the plan.

Mississippi Bar: equitable distribution and Ferguson factors

Spousal support

Alimony is considered after property division, using need, ability to pay, and the Armstrong factors.

Income, health, earning capacity, marriage length, children, fault, and assets matter; there is no fixed percentage guarantee. Ask a lawyer to review the budget and whether support negotiation costs extra.

Mississippi Bar: alimony and Armstrong factors

Parenting & child support

A rebuttable joint-custody and equal-time presumption applies to initial orders entered after July 1, 2026, not modifications.

The child's best interests and rebuttal factors still govern, including the family-violence presumption. Equal time does not mean zero child support. Ask a lawyer to review safety, evidence, the practical schedule, and whether the new-order rule applies.

Mississippi Code 93-5-24(2), (7) (official publisher), rechecked October 16, 2026

Agreed & simpler processes

Spouses may settle in writing or jointly consent to let the court decide specifically identified disputed issues.

The court must approve the arrangements or decide the submitted issues. Consent is not freely withdrawable once proceedings on it begin. Ask a lawyer to explain what you are consenting to and review the final judgment.

Mississippi Code 93-5-2 (official publisher), rechecked October 16, 2026

Help while a case is pending

On reasonable notice, the court may hear requests for temporary alimony, child custody, and child support.

Relief needs a request and court action; filing does not automatically set payments or a parenting schedule. Ask about urgent evidence and coverage for motions and appearances beyond initial advice.

Mississippi Code 93-5-17 (official publisher), rechecked October 16, 2026

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Legal aid and finding a lawyer

The Commission's partner directory is a starting point for finding courthouses and legal-help organizations. Before paying for a plan or service

Does the provider have a Mississippi attorney for the court and issue involved? Ask whether the service includes advice on the correct papers, review, service, negotiation, or court appearances, and what remains your responsibility.

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

The Commission links a Motion to Proceed In Forma Pauperis and a Pauper's Affidavit for requesting civil filing-fee relief based on finances. Confirm the current court-specific requirements, supporting information, and decision. Keep private attorney charges, service expenses, and subscription payments separate in the comparison. Source: civil filing-fee request materials.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
