A detail worth knowing

The Judicial Branch's divorce-without-children packet warns against using it when a spouse is active-duty military, alimony is requested, or a spouse has an employer pension or retirement plan. Having no children does not make every divorce fit the same packet. Source: packet restrictions.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Nebraska. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $7,500; a lawyer may help prepare but cannot represent you in the small-claims hearing.

The court allows attorney help with forms, not attorney-led appearances in this procedure. A defendant can request transfer to regular County Court at least two days before the hearing, where attorneys are allowed. Ask what the plan covers if that transfer changes your expected self-represented case.

Nebraska Judicial Branch: filing small claims, July 2025 limit

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

14 days after tenancy ends, with a written itemization of deductions.

Supply a forwarding address and keep proof of termination. Missing mailing instructions do not let the landlord simply keep the balance: the statute requires first-class mailing to your last-known address. Undeliverable or unclaimed money remaining outstanding for one year is handled as abandoned property through the State Treasurer.

Nebraska Revised Statute 76-1416

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills need two witnesses; the handwritten exception also addresses the signing date.

Witnesses observe signing or acknowledgment of the signature or will. For an unwitnessed handwritten will, the signature, material provisions, and an indication of the signing date generally must be handwritten; the statute provides specified ways to resolve a missing date. Ask for execution review rather than assuming any signed handwritten note qualifies.

Nebraska Revised Statutes 30-2328 and linked 30-2327

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwritten wills require a signature, material provisions, and a date subject to statutory alternatives. A missing handwritten date can qualify only under the statute's alternative conditions. Ask for review rather than relying on an undated note or an unwitnessed typed template.

Nebraska Revised Statutes 30-2328

Shared descendants: first $150,000 plus half the balance; nonshared descendants: half. These shares concern the intestate estate. A survivor's own other children do not trigger a different initial amount under this section. Review household assets and beneficiary accounts separately.

Nebraska Revised Statutes 30-2302

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will my plan lawyer review the will alongside ownership and beneficiary accounts, explain the signing process, and quote any customized family provisions separately? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Nebraska: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Usually one year of residence with intent to make Nebraska a permanent home.

A Nebraska marriage followed by continuous residence supplies another route; military residence has special rules. Ask about your actual eligibility before relocating or filing.

Nebraska Revised Statutes 42-349

Grounds & separation

The court determines whether the marriage is irretrievably broken.

A spouse's disagreement does not simply end the case. Bring the facts to a lawyer rather than treating separation or a signed form as a divorce.

Nebraska Revised Statutes 42-361

Timing: what starts the clock

The 60-day minimum starts after service is perfected, not automatically after filing.

A hearing or decree cannot bypass that clock. Completion, decree effect, and eligibility to remarry are separate questions; confirm dates before making commitments.

Nebraska Revised Statutes 42-363

Property & debts

The marital estate is divided equitably, including qualifying retirement benefits.

There is no universal half-of-each-asset rule. Ask whether plan review includes valuation, account classification, and the additional orders needed to divide retirement benefits.

Nebraska Revised Statutes 42-366

Spousal support

Alimony serves support, separately from the purpose of property division.

If the original decree allows no alimony, it cannot later be modified to add it. Get advice before exchanging support rights for an asset.

Nebraska Revised Statutes 42-365

Parenting & child support

A court-approved parenting plan addresses legal custody, physical custody, and child support.

Best interests govern; joint custody can be ordered with or without parental agreement under the statute. Discuss safety, exchanges, school, and daily responsibilities, not just labels.

Nebraska Revised Statutes 42-364

Agreed & simpler processes

A fully resolved, sworn agreement can allow a decree without a hearing after the minimum period.

Both parties must waive the hearing and complete the required filings; the court still needs jurisdiction and findings. Ask for independent review before signing the settlement.

Nebraska Revised Statutes 42-361(3)

Help while a case is pending

Temporary support and protective orders follow their own notice and evidence procedures.

Urgent relief is different from final resolution. Explain immediate needs and ask whether your prepaid benefit includes the motion and hearing, not only consultation.

Nebraska Revised Statutes 42-357

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in Nebraska

Understand the local process

Nebraska Judicial Branch: divorce without children. This packet has additional restrictions, including support, military, pregnancy, and retirement issues. Check the full eligibility list.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Nebraska. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

The self-help library is a starting point, not a guarantee that a form fits a particular case. The divorce guide's fee-waiver appendix lists an affidavit and application together with a proposed order. Read the relevant instructions and confirm current submission requirements with the court. Self-help library · Fee-waiver appendix.

Legal aid and finding a lawyer

Legal Aid of Nebraska explains that its online application may guide users toward self-representation resources, but submission does not guarantee limited or extended representation. Its instructions also direct some time-sensitive situations to the AccessLine or other resources. Check the program's current application options and case acceptance. Source: application scope and alternatives.

Before paying for a plan or service

Will a Nebraska attorney identify issues beyond the standard packet, including retirement assets or requested support? Ask whether the plan covers advice, drafting, review, negotiations, and appearances, or only selected tasks.

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Use the current court-cost schedule rather than an old packet's estimate. The fee-waiver appendix explains that court approval is needed and that certain other costs may be covered; read the order and confirm remaining expenses instead of assuming every litigation charge disappears. Current fee schedule · Fee-waiver guidance.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
