A detail worth knowing

Guide & File is a free online service for preparing court documents in selected case types, including absolute divorce, small claims, and petitions to proceed as an indigent. Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for North Carolina. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

The local limit ranges from $5,000 to $10,000.

Ask the county clerk for the applicable limit rather than treating $10,000 as universal. Court location and claim type also matter; a higher-value claim can require a different division.

North Carolina Judicial Branch: court divisions

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

30 days for accounting and balance; an undetermined claim allows final accounting within 60 days.

Both clocks run after tenancy termination and delivery of possession. The landlord must give an interim accounting by day 30 when the claim cannot yet be determined; 60 days is not an automatic extension without that step.

North Carolina General Statutes section 42-52

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

An attested written will needs at least two competent witnesses, but they need not sign together.

Witnesses must sign in the testator's presence, not necessarily each other's. Signing or acknowledging the signature may occur before them separately. Other will types have different rules; follow the selected document's execution instructions.

North Carolina General Statutes section 31-3.3

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

An entirely handwritten, signed will can omit attesting witnesses. The writing must meet the statutory handwriting and name/signature rules. Unrelated printed matter can be allowed only under the statute's conditions; a signed typed form is not the handwritten exception.

North Carolina G.S. 31-3.4

Land and personal property have different spouse-share rules. One surviving child line: the spouse gets half the intestate real property and the first $60,000 of net personal property plus half its balance. Two or more child lines: one-third of the real property and the first $60,000 of net personal property plus one-third of its balance. If net personal property is no more than $60,000, the spouse receives all of that property.

North Carolina G.S. 29-14

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Can a covered attorney check the house title and explain children's possible shares before I assume a simple will covers everything? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

North Carolina: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Either spouse must have lived in North Carolina for six months before filing.

The ordinary absolute-divorce route also requires a year and a day of separation. Child-custody jurisdiction and authority over an out-of-state spouse need separate checks.

North Carolina Courts: separation and divorce

Grounds & separation

Ordinary no-fault divorce requires a year and a day living in different homes.

At least one spouse must intend permanent separation. Ending the relationship while sharing the same home generally does not start this separation period. Fault is not a shortcut around it.

North Carolina Courts: separation requirements

Timing: what starts the clock

The separation period precedes filing; service and court steps follow.

The court's simple-divorce packet ordinarily calls for waiting 30 days after service before arranging the hearing. Extensions, waivers, and local procedure can affect the next step; filing does not end the marriage.

North Carolina Courts: divorce packet and steps

Property & debts

Equal division is the starting point, but equitable division can differ.

Classify marital, separate, and divisible property and related debt. An unfiled equitable-distribution claim is generally lost at final absolute divorce; get advice before using a divorce-only packet.

North Carolina Courts: property and claim deadlines

Spousal support

Alimony depends on dependency, ability to support, and statutory factors.

Certain marital misconduct can determine entitlement; amount and duration have no universal formula. An unfiled alimony claim is generally lost at final absolute divorce, not automatically available later.

North Carolina Courts: alimony and claim deadlines

Parenting & child support

Custody focuses on the child's welfare, and is separate from ending the marriage.

Custody and child-support claims are not extinguished by absolute divorce. Existing orders, safety concerns, jurisdiction, and support procedures still need attention.

North Carolina Courts: child custody

Agreed & simpler processes

The court's simple-divorce packet does not resolve property, alimony, or parenting.

It is not the right tool for preserving financial claims you still need to pursue. A consultation about claim deadlines may be more valuable than buying document preparation alone.

North Carolina Courts: packet limits

Help while a case is pending

Postseparation support can help before a final alimony decision.

It requires a request and evidence about resources, needs, and ability to pay. Do not assume the year of separation means you must wait a year to ask about financial or safety help.

North Carolina G.S. 50-16.2A: postseparation support

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in North Carolina

Understand the local process

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose North Carolina. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

The judiciary's Guide & File page explains that Judicial Branch employees cannot provide legal advice or fill out forms for the public. Before buying a document package, ask which local requirements it handles and what you must file or serve yourself. For advice about rights and remedies, consult a qualified attorney. Legal aid and finding a lawyer

Legal Aid of North Carolina provides a starting point for civil legal assistance and has an application route. The State Bar's attorney-finding page points to lawyer resources and suggested questions for hiring counsel. Neither a public resource listing nor an application establishes that someone will represent you. Ask about eligibility, case types, conflicts, and capacity. Before paying for a plan or service

Would the free guided form tool cover document preparation for this case, and what would paid attorney review add? Does the quote include local filings, service, and advice about issues outside the form packet?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

The court-cost guide distinguishes initial filing costs from additional expenses such as service of papers. It also explains petitions to file as an indigent and warns that some costs may be collected later. Ask the clerk about required financial information and local procedures; do not assume relief from advance payment eliminates every expense. Source: civil costs and indigent filing.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
