Before you rely on a plan

A detail worth knowing

The Center warns that its forms are not official court forms and that courts are not required to accept them. A form appearing on the court website is therefore not a guarantee of acceptance or suitability for every case. Check the instructions and the requirements of the court handling your matter. Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for North Dakota. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $15,000; the small-claims decision cannot be appealed.

A defendant has 20 days after service to request a hearing or remove the case to regular District Court. That choice changes the process; remaining in small claims means accepting a final, nonappealable decision. A prepaid consultation before the deadline can help you assess the evidence and the implications of choosing either route.

North Dakota Courts: small claims and removal

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

30 days after lease termination and delivery of possession.

Both events matter, so document when you returned possession and give your forwarding address. The landlord must provide written itemization and the remaining deposit; reasonable wear is excluded from chargeable repair or cleaning. Interest is not required when occupancy was less than nine months. Ask for review of the charges and dates before assuming a refund is overdue.

North Dakota section 47-16-07.1

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Two witnesses or a qualifying notarial acknowledgment; handwriting is a separate route.

The ordinary written-will rule permits either two witnesses signing within a reasonable time after the required act, or acknowledgment before a notary or another authorized officer. A qualifying handwritten will instead requires the signature and material portions in handwriting. Execution and self-proving paperwork are different questions: ask which procedure your provider is actually completing.

North Dakota section 30.1-08-02

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

A signature and material portions in the maker's handwriting can qualify without ordinary witnessing. An unwitnessed typed template is not the handwritten exception. Ask for review of gifts, backup beneficiaries, and account coordination rather than assuming handwritten wording completes the plan.

North Dakota Century Code 30.1-08-02(2)

All-shared descendants can mean all; blended families use initial amounts plus half the balance. All requires shared descendants and no other surviving descendants of the spouse. If only the spouse has others: first $225,000 plus half; if the deceased has nonshared descendants: first $150,000 plus half. Review nonprobate assets separately.

North Dakota Century Code 30.1-04-02

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will my plan lawyer confirm the execution route, coordinate beneficiary accounts with spouse and children's interests, and explain separately priced planning beyond the basic will? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

North Dakota: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

The filer needs six months' good-faith residence before starting or immediately before the decree.

The alternative decree-based route is different from the court packet's filing eligibility. Ask which procedure fits before filing, especially when parenting jurisdiction is also involved.

North Dakota Century Code 14-05-17

Grounds & separation

Irreconcilable differences support no-fault divorce; other grounds require proof.

The court's self-help forms do not cover fault divorces. Ask a lawyer before trying to adapt a no-fault packet to a different ground.

North Dakota Courts: divorce grounds

Timing: what starts the clock

Agreement and court caseload affect completion; the 21-day answer deadline is a different clock.

That response period starts the day after service. A default still requires court steps, not just waiting. Ask about interim relief when immediate needs cannot wait for final judgment.

North Dakota Courts: timing and response

Property & debts

Property and debts are distributed equitably, with a specified valuation-date framework.

If spouses do not agree on a valuation date, the statute generally uses 60 days before the initially scheduled trial, with adjustment provisions. Ask which date and account records your settlement uses.

North Dakota Century Code 14-05-24

Spousal support

Current support law provides limited-duration awards, not permanent spousal support.

Need, ability to pay, award type, and duration limits matter. Ask how current rules apply to a new request versus an older award; do not assume a long marriage guarantees lifetime payments.

North Dakota Century Code 14-05-24.1

Parenting & child support

Child-support calculations are required even when the spouses agree about support.

The judge decides whether a waiver, stay, or different amount meets the applicable standard. Review the worksheet alongside residence, parenting time, healthcare, and expenses rather than omitting support by agreement.

North Dakota Courts: required child-support calculations

Agreed & simpler processes

A complete written agreement filed together can usually be resolved without a hearing.

Every issue and required document must be addressed. The self-help center warns its forms do not fit every case; ask your plan lawyer to review eligibility and retirement work beyond the packet.

North Dakota Courts: filing a complete agreement

Help while a case is pending

Temporary orders can address support, attorney expenses, and parenting responsibilities.

Appropriate protection relief has additional statutory requirements. Ask what evidence and procedure apply, and whether your benefit includes representation at the requested hearing.

North Dakota Century Code 14-05-23

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in North Dakota

Understand the local process

North Dakota Courts: divorce self-help. Read the limits of the self-help materials and available processes.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose North Dakota. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

The Center does not supply a form for every issue. Its fee-waiver page links to general-use checklists as a starting point when a specific form is unavailable. Confirm the local filing process and seek qualified help when the available materials do not fit your circumstances. Source: forms and limitations.

Legal aid and finding a lawyer

The court's lawyer-finding page lists Legal Services of North Dakota, Dakota Plains Legal Services, the State Bar Association's referral service, and a licensed-attorney search. Programs differ in geography, eligibility, and scope; the directory also distinguishes civil self-help from criminal-defense assistance. Ask the program or attorney what help is available. Source: attorney and legal-aid options.

Before paying for a plan or service

Will the plan provide a North Dakota attorney for your type of civil case? Ask who checks form suitability and who handles legal advice, service, filing, and courtroom representation.

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

If a civil filing fee is unaffordable, the court's page describes a written request for a waiver and provides instructions and forms. Approval concerns the filing fee; do not treat it as paid attorney representation or assume that a subscription covers every remaining expense. Source: fee-waiver overview.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
