A detail worth knowing

The judiciary provides court interpreters at no cost to limited-English-proficient court users, but interpreters cannot give legal advice or advocate for you. Its guidance says municipal and probate courts are outside that judiciary interpreter service; contact those local courts directly about arrangements. Request assistance as soon as you receive a court date. Source: interpreter request guidance.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Rhode Island. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $5,000 for eligible money claims; the plaintiff gives up the right to appeal.

This is not a catch-all route for every low-value dispute: the statute specifies eligible claim categories. The current self-represented packet explains that an answered case goes to mediation before an unresolved claim reaches trial. Before filing, ask a prepaid lawyer whether your claim fits and whether accepting the plaintiff's appeal waiver makes sense for your evidence.

Rhode Island Judiciary: small-claims complaint and instructions

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

20 days after the last of tenancy termination, possession return, and a forwarding address.

Providing the forwarding address is part of the statutory trigger, not just a courtesy. Keep proof of all three events. The landlord must itemize deductions in writing and return the balance; ordinary wear is not physical damage. A prepaid consultation can help separate an actual deadline violation from a clock that has not yet started.

Rhode Island section 34-18-19

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

The two witnesses must be present together when you sign or acknowledge the signature.

Witnesses then sign in the maker's presence. Collecting unrelated witness signatures later is not the ordinary ceremony, and notarization alone does not replace it. A separate statute recognizes qualifying wills executed outside Rhode Island. Ask for execution review when using a template or bringing an existing will from another state.

Rhode Island sections 33-5-5 and 33-5-7

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwriting alone does not remove ordinary witness requirements; an out-of-state signed written will may qualify under another state's rules. Foreign execution depends on the law of the place of execution or the maker's domicile. Have a lawyer check an old handwritten document or an interstate move instead of assuming every unwitnessed note qualifies.

Rhode Island General Laws 33-5-5 and 33-5-7

With descendants, the spouse generally receives half of surplus personal property; real estate has a separate life-estate rule. A life estate is not outright ownership. Ask about the home, title, debts, and beneficiary accounts, plus the separate court-discretionary real-estate allowance. A will and ownership review may be more useful than assuming a single percentage covers everything.

Rhode Island General Laws 33-1-10; real estate in 33-1-5 and 33-1-6

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will my plan lawyer distinguish my home's ownership from a life estate, review beneficiary accounts and family needs with the will, organize signing, and quote any trust or deed work outside the benefit? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Rhode Island: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

The ordinary rule is one year of Rhode Island domicile and residence before filing.

A qualifying resident defendant who is actually served can satisfy the requirement when the plaintiff does not. Military-related provisions also matter. Ask a lawyer to check residence, service, venue, and child jurisdiction separately.

Rhode Island General Laws 15-5-12

Grounds & separation

Irreconcilable differences that irreparably break down the marriage are a no-fault ground.

No-fault grounds do not make conduct irrelevant to every financial or parenting issue. Use a consultation to distinguish ending the marriage from negotiating its consequences.

Rhode Island General Laws 15-5-3.1

Timing: what starts the clock

The ordinary final-judgment wait is three months after trial and decision, not three months from filing.

Entry of the final judgment is another required step. A different rule applies to the three-year-separation ground. Ask a lawyer to confirm the applicable route and final entry before making remarriage plans.

Rhode Island General Laws 15-5-23; separation exception in 15-5-3

Property & debts

Property assignment follows statutory fairness factors; premarital income and effort-related appreciation can still matter.

Premarital property, inheritance, and third-party gifts have protections, but their treatment is not captured by the account's title alone. Bring ownership and value records for classification and settlement review.

Rhode Island General Laws 15-5-16.1

Spousal support

Alimony generally supports a transition to self-sufficiency; an indefinite award is possible in appropriate circumstances.

Need, ability to pay, care responsibilities, work history, and statutory factors matter. Ask a lawyer to assess your budget and confirm whether drafting, negotiation, or contested proceedings are included in your benefit.

Rhode Island General Laws 15-5-16(b)-(c)

Parenting & child support

Custody and visitation involve the child's best interests; abuse can justify denying visitation.

The ordinary visitation rule has exceptions, not a guaranteed schedule. Explain safety concerns and the child's actual needs to counsel, and get a separate support calculation rather than assuming a custody label determines payment.

Rhode Island General Laws 15-5-16(d)-(e)

Agreed & simpler processes

A divorce cannot be granted solely from default or admissions; a court trial is still required.

Even if terms are agreed, ask who will prepare the evidence, attend court, and obtain the final judgment. Document preparation alone is not the whole process, and contested issues may exceed a basic prepaid benefit.

Rhode Island General Laws 15-5-22

Help while a case is pending

The Family Court has interim support, custody, and restraining-order powers under specified conditions.

Ask promptly about a request for immediate support or protection and the required showing. Confirm whether a plan lawyer handles the application and appearance; ordinary plan enrollment is not an emergency response.

Rhode Island General Laws 15-5-19

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Forms and local filing

Legal aid and finding a lawyer

Rhode Island Legal Services describes civil legal assistance and representation for low-income individuals and eligible groups. Its application notice says submitting an application does not mean it can help; potential eligibility and the particular problem must be reviewed. The judiciary also links a bar-association lawyer referral program. Legal Services scope and application notice · Judiciary referral resources.

Before paying for a plan or service

Does the plan supply a Rhode Island attorney for the relevant court, including a local municipal or probate matter if applicable? Ask what advice and appearances are included and who coordinates language-access needs.

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Ask the filing court for its current fee schedule and whether a fee-relief application is available for your case. Budget service and attorney charges separately. Court interpreter assistance described by the judiciary is not a commercial plan benefit and does not pay for your lawyer. Court forms starting point · Interpreter service scope.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
