Before you rely on a plan

A state rule does not tell you whether a plan covers your issue. Check the product, effective date, existing-matter rules, lawyer network, and extra costs.

A detail worth knowing

The simple-divorce packet is not a universal divorce kit. Its instructions limit it to specified circumstances, including the separation ground and agreement about relevant property, debt, and child-related issues. Check all criteria before using it; a subscription or automated questionnaire cannot make an unsuitable packet appropriate. Source: packet eligibility instructions (PDF).

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for South Carolina. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $7,500 in Magistrate Court; identify the correct defendant before filing.

Charleston County's court guidance illustrates a practical trap: a business's trading name may not identify the party or registered agent you need to serve. Supply a clear legal name and service address, and check your own county's filing instructions. A prepaid consultation can help identify whom to sue and assemble proof before you pay filing or service costs.

Charleston County court guidance; statewide Magistrate limit

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

30 days after termination, possession return, and your demand, whichever is later.

Do not count only from moving day. Make a documented demand and provide your forwarding address in writing. The landlord must send itemized deductions and the balance. Failure to provide an address can affect statutory damages when the landlord had no notice of your whereabouts and mailed to your last-known address. Ask for help checking both the demand and delivery record.

South Carolina section 27-40-410

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills require two witnesses; a notary is not a replacement for them.

Each witness must witness signing or acknowledgment of the signature or will. The self-proving procedure is a separate step intended to simplify proof later, not a substitute for execution. A separate choice-of-law rule can recognize a qualifying will from another jurisdiction. Ask the provider to check the signing procedure and any existing out-of-state document.

South Carolina sections 62-2-502, 62-2-503 and 62-2-505

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwritten wills ordinarily need the same witnesses. A separate personal-property list is not a whole will, and recognition of wills made elsewhere is another issue. Have a lawyer review informal instructions instead of treating a handwritten signature as a witness exemption.

South Carolina Code 62-2-502, 62-2-505, and 62-2-512

With surviving descendants, the spouse receives half of the intestate estate. The half-share applies whether descendants are shared or from another relationship. Without surviving descendants the spouse receives all under this section. Family protections and transfers outside the intestate estate need separate review.

South Carolina Code 62-2-102

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Does the basic will benefit include planning for a surviving spouse and children, plus witnessing and beneficiary review, or are customized provisions separately billed? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details

South Carolina: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Usually one year's residence; both-resident cases allow three months for the plaintiff.

A nonresident plaintiff can rely on the defendant's qualifying one year. Residence and county venue are different checks. A vacation or wedding here does not alone create divorce jurisdiction.

South Carolina Code 20-3-30

Grounds & separation

The no-fault route needs one year apart without cohabitation.

Specified fault grounds also exist. Irreconcilable differences alone is not this state's statutory ground. Ask about evidence and alternatives before choosing a document-only route.

South Carolina Code 20-3-10

Timing: what starts the clock

The general three-month filing minimum has exceptions for separation and desertion.

Those grounds can proceed after the response or default stage without that extra three-month minimum. Their own ground requirements remain. Neither a minimum period nor agreement guarantees a court date.

South Carolina Code 20-3-80

Property & debts

Marital property is apportioned equitably, using multiple factors.

Contributions, finances, and specified misconduct can matter. Title alone does not classify marital property. Bring asset records and the whole settlement to review, rather than assuming every item divides equally.

South Carolina Code 20-3-620 and 20-3-630

Spousal support

Alimony type and conduct can materially affect eligibility.

Adultery before the statutory settlement or order cutoff bars an award. Different support types have different consequences. Obtain advice before waiving support or relying on an informal promise.

South Carolina Code 20-3-130

Parenting & child support

Best interests control; joint decisions and living arrangements are distinct.

Custody orders can allocate major decisions and residential arrangements separately. Domestic violence, abuse, and coercive involvement of children matter. Agreement is not a reason to overlook safety or a child's practical needs.

South Carolina Code 63-15-210 through 63-15-240

Agreed & simpler processes

The simple-divorce packet is for qualifying one-year-separation cases.

Property and debts must be absent or agreed; child arrangements must also be agreed and support meet guidelines. Instructions call for separate dwellings. Ask a lawyer to review the agreement before filing; the packet is not for every contested case.

South Carolina Judiciary: simple-divorce instructions (PDF)

Help while a case is pending

Temporary relief requires a specific motion and supporting evidence.

Current Rule 21 governs pending-case hearings, notice, and affidavits. Emergency protection follows distinct requirements. Ask promptly about the correct procedure rather than waiting for plan eligibility or final divorce.

South Carolina Family Court Rule 21: current procedure

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in South Carolina

Understand the local process

South Carolina Judicial Branch: simple divorce packets. These packets have specific eligibility limits; read them first.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose South Carolina. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

The judiciary's packet page separates plaintiff and defendant documents and links to instructions, service forms, and hearing materials. Its self-help page explains that court staff can provide procedural information and approved forms but cannot tell you what to write or predict the outcome. Confirm the correct court and current documents before filing. Packet collection · Court-staff limits.

Legal aid and finding a lawyer

The Access to Justice Commission's Legal Resource Finder uses income, location, and the legal issue to tailor information and referrals, incorporating provider eligibility criteria. A referral is a starting point, not guaranteed representation. Contact the provider to confirm current availability and the help it can offer. Source: Legal Resource Finder.

Before paying for a plan or service

Has the provider checked whether the court's simple-divorce packet fits the matter? If there are disputed issues or the case falls outside that packet, does the plan supply attorney advice and representation rather than only paperwork?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Family Court form SCCA 405 requests waiver of filing and service costs and asks for financial information about income, assets, expenses, and household dependents. Follow the current form and court instructions, including the affidavit requirements. A submitted request is not an approved waiver, and court fee relief does not establish coverage under a paid plan. Source: Family Court fee-relief motion (PDF).

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
