Wills, estates & planning ahead
Legal help in Colorado
A prepaid plan may help you turn decisions about family, money, and care into usable documents. Preparing your own will is a different service from administering someone else's estate. Choose the job you need help with.

I need a will or want to update one
Practical starting guidance, not a complete Colorado legal procedure.
What to do first
Start with who depends on you, who should make decisions if you cannot, and who should receive or manage what you leave.
Deadlines and urgent risks
A drafted form is not necessarily a validly executed will. Signing rules, family circumstances, and asset ownership need attention.
Steps to take
- List dependents, intended beneficiaries, a proposed personal representative, and any guardian you want to nominate for children. Flag blended families, a beneficiary receiving needs-based benefits, or property in another state.
- Separate assets controlled by the will from accounts with beneficiaries, jointly titled property, and trust assets. Ask the lawyer what needs a document change and what needs an account or ownership change.
- Request a complete quote: advice, drafting, revisions, the signing method, and storage of the original. Ask who helps if the plan's simple-will benefit does not fit your family.
From our Colorado research
Will-signing research reviewed October 11, 2026. These are selected rules, not instructions for every will type.
Wills
Ordinary signed wills can use two witnesses or acknowledgment before an authorized notary.
The court's instructions describe these as alternative execution routes. Witnesses sign within a reasonable time after signing or acknowledgment; the notarial route requires the maker's acknowledgment. Handwritten and self-proved wills have separate requirements, so follow the chosen document's instructions.
Colorado Judicial Branch: probate instructions 34:2 and related will types
Ask your prepaid plan: Is a lawyer checking the document and explaining signing, or are you receiving a form to finish yourself?
What about a handwritten will?
Colorado recognizes a qualifying holographic will when the signature and material portions are in the maker's handwriting. This is a separate route, not a shortcut for a partly completed typed template.

What may happen next
For example, naming a child in a will does not by itself change a retirement account's beneficiary. A useful review identifies those separate tasks, then leaves you with signing instructions, a place for the original, and a reason to return after a major life change.
Documents to gather
Existing wills and trusts, account titles and beneficiary confirmations, property locations, debts, family relationships, and names of proposed decision-makers and backups.

Where prepaid help may fit
Does the benefit include advice, drafting, revisions, signing instructions, and a review of beneficiary coordination?
What it may not cover
Trusts, estate taxes, complex families, special-needs planning, and probate work may require separate expertise or fees.

Common questions
Does an included will mean I also get a trust?
Not necessarily. Ask which documents, revision rounds, and asset-transfer tasks are included. Have the lawyer explain the particular problem a trust would solve before paying for one.
Can I use the same document after moving?
Have a lawyer review it rather than assuming you must replace everything or that nothing needs changing. Ask whether your plan covers that review, new signing, and updates to other planning documents.

I want someone to help if I cannot decide
Practical starting guidance, not a complete Colorado legal procedure.
What to do first
Choose who you trust for financial and health decisions, and discuss willingness and backup choices.
Deadlines and urgent risks
A will does not appoint someone to act during your lifetime. Financial authority and health-care decisions use different documents and rules.
Match the document to the decision
- Financial power of attorney: authority over specified property and money matters. Colorado's statutory financial form does not authorize health-care decisions. Section 15-14-741.
- Medical durable power of attorney: appoints a health-care agent, subject to the document and Colorado law. Ask when authority applies and how your wishes will be communicated. Section 15-14-506.
- Living will: records certain future treatment directions for the circumstances defined by law. It serves a different purpose from naming an agent, even if combined in one compliant document. Section 15-18-104.
Steps to take
Tell the plan lawyer which decisions worry you: paying bills during an illness, talking with clinicians, or treatment preferences. Ask for the right documents, backup agents, a review of existing instructions, and document-specific signing guidance. A will-only benefit may leave these jobs unfinished.
Discuss medical preferences with your clinician and proposed agent. UCHealth's advance-directive discussion guide explains the practical conversations; it is a health-provider resource, not a substitute for legal review.
What may happen next
Signed documents need to reach the people and institutions expected to use them. Ask your bank and care team how they record copies. For a planned procedure, arrange this in advance; buying a subscription does not establish that an agent already has authority.
Documents to gather
Existing powers of attorney and directives, proposed agents and backups, care-team contacts, and a list of the accounts or decisions needing attention. Bring conflicting or outdated documents to the lawyer.
Do not enter documents or private case details into this site's search.
Which rules apply?
Signing, authority, and use depend on the document. Do not treat notarization as a universal requirement for every financial power of attorney: Colorado's signature and acknowledgment rules distinguish those questions.

Sources checked October 15, 2026. Capacity concerns or an existing disagreement call for individual legal help, not simply another form.
Where prepaid help may fit
Are a financial power of attorney and health-care directive included, with state-specific advice?
What it may not cover
A document package is not a capacity evaluation, guardianship proceeding, or a guarantee every institution accepts a form.
Ask for the written coverage terms · Compare the actual extra costs
Common questions
Will my financial agent automatically make medical decisions?
No. Ask the lawyer to check both kinds of authority and the documents already in place. The same trusted person might fill both roles, but one title does not supply every power.
What if someone can no longer make a document?
Ask a qualified lawyer promptly about existing authority and the appropriate next step. A prepaid drafting benefit is not a capacity determination or an included guardianship case. Confirm urgency and fees rather than waiting for a new plan to take effect.

Someone died or there is no will
Practical starting guidance, not a complete Colorado legal procedure.
What to do first
Locate any original documents and identify the property, debts, and people who may have an interest.
Deadlines and urgent risks
A will, no-will inheritance rules, and beneficiary transfers are different checks. Do not distribute property based only on a simplified inheritance summary.
Steps to take
- Make an inventory with values, ownership, named beneficiaries, and debts. A beneficiary transfer, a small-estate affidavit, and a court appointment are different routes.
- Use the Colorado Judicial Branch estate guide to identify the possible process. The existence of a will alone does not settle whether probate is needed.
- Ask your plan for an initial estate consultation and a written quote for any further work. Confirm whether the lawyer would represent you individually or undertake work for an estate.
Could the small-estate affidavit fit?
For a death in 2026, Colorado's current JDF 998 instructions and JDF 999 affidavit list an $88,000 limit, measured as specified in the form after liens and encumbrances. The death year controls the listed limit, not the year you apply.
- At least 10 days must have passed since death.
- This is a personal-property route, not a transfer of real estate.
- The affidavit requires that no personal-representative application or petition is pending or has been granted in any jurisdiction, along with the other statements in the form.
- You present it to the asset-holder; you do not file it as a court case. The Colorado DMV requires its separate motor-vehicle form, DR 2712, rather than JDF 999.

Colorado: a selected no-will distinction
Shared-family cases can pass entirely to the spouse; other cases use an adjusted amount plus half.
The spouse receives all when all the deceased's descendants are shared and the survivor has no other descendants. Otherwise the applicable initial amount depends on whose descendants are nonshared, followed by half the balance. The statutory dollar amounts are inflation-adjusted; verify the death-year amount rather than using the base figure.
Colorado Revised Statutes 15-11-102
Reviewed October 11, 2026. Selected spouse/descendant rules, not a full inheritance calculation. Non-probate assets and family exceptions need separate review.
What may happen next
A qualifying account might be collected without opening an estate, but collection still carries responsibilities to the people entitled to it. If an estate must be opened, ask whether informal or formal probate fits. A disputed will, unclear heirs, or real property is a reason to obtain a case-specific explanation and fee quote.
Documents to gather
Death certificate, original will, death date, account titles and beneficiary records, property values and liens, debts, family relationships, and any existing probate case or appointment.
Do not enter documents or private case details into this site's search.
Which court or institution?
For a Colorado estate court case, the court guide directs you to the district court where the deceased lived, or Denver Probate Court for Denver. An affidavit instead goes to the property-holder. Out-of-state property can need separate review.

Can a plan lawyer explain the initial process or review the documents?
What it may not cover
Probate administration, disputes, tax returns, and representation of an estate may not be included in a personal will benefit.
Ask for the written coverage terms · Compare the actual extra costs
Common questions
Does the plan that prepared the will also handle probate?
Do not assume so. Ask about estate consultations, affidavit review, court filings, creditor work, and distributions separately. A personal will benefit may not include representing a personal representative or the estate.
Can a small-estate affidavit transfer a house?
No. JDF 999 is not a real-estate transfer procedure. Ask an estate lawyer about the title and the appropriate route rather than relying only on the estate's dollar value.

County or court details: Use the court named on your papers. Ask about local forms, filing, service, fees, response dates, and hearings. A statewide form may need local additions.
Find local civil legal aid. Eligibility, scope, and availability vary; applying does not establish representation or stop a deadline.
These agencies and directories serve different purposes. Court staff explain procedure, not individualized advice. Civil legal aid is not the usual source of criminal defense.
