I need a will or want to update one
Practical starting guidance, not a complete Iowa legal procedure.
What to do first
Start with who depends on you, who should make decisions if you cannot, and who should receive or manage what you leave.
Deadlines and urgent risks
A drafted form is not necessarily a validly executed will. Signing rules, family circumstances, and asset ownership need attention.
Steps to take
Inventory assets, debts, accounts, beneficiaries, and existing documents. Ask the lawyer to reconcile the will with ownership and beneficiary designations.

Wills
The ordinary route needs two competent witnesses in the maker's presence and each other's.
The maker declares the document is a will and requests the witnesses. Iowa allows presence through real-time electronic communication in which everyone can see and hear the acts; remote counterparts have additional assembly rules. Ask for signing guidance rather than treating a downloaded document as finished.
Iowa Code 2026 section 633.279: signing and remote presence
Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.
Handwritten wills and inheritance defaults
Handwriting alone does not create a general unwitnessed-will exception. A will executed outside Iowa can have a different recognition route. Have a lawyer review where and how an existing will was signed rather than discarding it or assuming a handwritten note qualifies.
Iowa Code 2026, 633.283; ordinary execution in 633.279
Shared descendants generally leave the estate to the spouse; nonshared descendants trigger a different, asset-specific share and $50,000 minimum. The nonshared rule generally gives half of qualifying real property and other personal property, all exempt personal property, and an available net-estate top-up to $50,000. This is not the first $50,000 plus half. Ask a lawyer to review debts, allowances, title, and beneficiaries separately.
Iowa Code 2026, 633.212; shared-descendant rule in 633.211
These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.
Planning follow-through: Can my plan lawyer check the will, signing process, asset ownership, and family relationships together, and explain what customized blended-family planning would cost beyond the basic benefit? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.
What may happen next
Drafting should be followed by proper signing, storage, and review after major changes. A trust is not automatically necessary for everyone.
Documents to gather
Existing will and trusts, asset and debt inventory, beneficiary forms, and intended decision-makers.

Which rules apply?
Statewide law, local court procedure, and federal or agency rules are different checks. Where a local rule matters, use the county and court identified on your documents.

Common questions
Can I buy a plan now for this problem?
Ask about effective dates, waiting periods, and existing-matter exclusions before paying. Do not assume a new subscription covers an issue that has already started.
Does a consultation mean I have a lawyer for the next step?
No. Confirm the scope, who will handle any filing or appearance, responsibility for deadlines, and additional fees. Get a separate engagement if required.

I want someone to help if I cannot decide
Practical starting guidance, not a complete Iowa legal procedure.
What to do first
Choose who you trust for financial and health decisions, and discuss willingness and backup choices.
Deadlines and urgent risks
A will does not appoint someone to act during your lifetime. Financial authority and health-care decisions use different documents and rules.
Steps to take
Ask about the appropriate financial power of attorney and health-care directive, activation, scope, signing, and how institutions will receive copies.
What may happen next
Documents need valid execution and practical access. Institutions or clinicians may have their own review processes.
Documents to gather
Existing authority documents, trusted contacts, care preferences, and relevant account information.

Are a financial power of attorney and health-care directive included, with state-specific advice?

Someone died or there is no will
Practical starting guidance, not a complete Iowa legal procedure.
What to do first
Locate any original documents and identify the property, debts, and people who may have an interest.
Deadlines and urgent risks
A will, no-will inheritance rules, and beneficiary transfers are different checks. Do not distribute property based only on a simplified inheritance summary.
Steps to take
Ask a local estate lawyer or probate self-help resource which assets need a court process and who has authority to act.
Iowa: a selected no-will distinction
Shared descendants generally leave the estate to the spouse; nonshared descendants trigger a different, asset-specific share and $50,000 minimum.
The nonshared rule generally gives half of qualifying real property and other personal property, all exempt personal property, and an available net-estate top-up to $50,000. This is not the first $50,000 plus half. Ask a lawyer to review debts, allowances, title, and beneficiaries separately.
Iowa Code 2026, 633.212; shared-descendant rule in 633.211
Reviewed October 11, 2026. Selected spouse/descendant rules, not a full inheritance calculation. Non-probate assets and family exceptions need separate review.
What may happen next
Some assets may transfer outside probate; others may need a court process. Responsibility for debts and distribution needs individual review.
Documents to gather
Death certificate, original will if found, account titles and beneficiaries, debt information, and family relationships.

State court and legal-help directory
County or court details: Use the court named on your papers. Ask about local forms, filing, service, fees, response dates, and hearings. A statewide form may need local additions.
Find local civil legal aid. Eligibility, scope, and availability vary; applying does not establish representation or stop a deadline.
These agencies and directories serve different purposes. Court staff explain procedure, not individualized advice. Civil legal aid is not the usual source of criminal defense.
