I need a will or want to update one
Practical starting guidance, not a complete New Hampshire legal procedure.
What to do first
Start with who depends on you, who should make decisions if you cannot, and who should receive or manage what you leave.
Deadlines and urgent risks
A drafted form is not necessarily a validly executed will. Signing rules, family circumstances, and asset ownership need attention.
Steps to take
Inventory assets, debts, accounts, beneficiaries, and existing documents. Ask the lawyer to reconcile the will with ownership and beneficiary designations.

Wills
At least two credible witnesses; qualifying remote witnessing still uses a paper will.
Witnesses attest to the maker's signature at the maker's request and in their presence. Remote presence requires simultaneous sight and sound plus the specified attorney-related notarial supervision; paper counterparts are permitted. This rule expressly does not authorize an electronic will. Ask the provider about the ceremony and supervision, not just a video appointment.
New Hampshire RSA 551:2: execution and remote presence
Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.
Handwritten wills and inheritance defaults
Handwriting alone does not remove the ordinary witness requirement. Recognition of documents validly made elsewhere is a separate rule. Ask for review after a move; do not assume another state's handwritten exception permits a new unwitnessed New Hampshire will.
New Hampshire RSA 551:2 and 551:5
Shared descendants with no others: first $250,000 plus half; blended families use lower initial amounts. If only the spouse has other descendants: first $150,000 plus half; if the deceased has nonshared descendants: first $100,000 plus half. These concern the intestate estate, not every beneficiary account or jointly owned asset.
New Hampshire RSA 561:1
These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.
Planning follow-through: Will my plan lawyer check how spouse and children's interests fit with titles and beneficiary forms, and include the execution and update work needed to keep the documents usable? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.
What may happen next
Drafting should be followed by proper signing, storage, and review after major changes. A trust is not automatically necessary for everyone.
Documents to gather
Existing will and trusts, asset and debt inventory, beneficiary forms, and intended decision-makers.

Which rules apply?
Statewide law, local court procedure, and federal or agency rules are different checks. Where a local rule matters, use the county and court identified on your documents.

Common questions
Can I buy a plan now for this problem?
Ask about effective dates, waiting periods, and existing-matter exclusions before paying. Do not assume a new subscription covers an issue that has already started.
Does a consultation mean I have a lawyer for the next step?
No. Confirm the scope, who will handle any filing or appearance, responsibility for deadlines, and additional fees. Get a separate engagement if required.

I want someone to help if I cannot decide
Practical starting guidance, not a complete New Hampshire legal procedure.
What to do first
Choose who you trust for financial and health decisions, and discuss willingness and backup choices.
Deadlines and urgent risks
A will does not appoint someone to act during your lifetime. Financial authority and health-care decisions use different documents and rules.
Steps to take
Ask about the appropriate financial power of attorney and health-care directive, activation, scope, signing, and how institutions will receive copies.
What may happen next
Documents need valid execution and practical access. Institutions or clinicians may have their own review processes.
Documents to gather
Existing authority documents, trusted contacts, care preferences, and relevant account information.

Someone died or there is no will
Practical starting guidance, not a complete New Hampshire legal procedure.
What to do first
Locate any original documents and identify the property, debts, and people who may have an interest.
Deadlines and urgent risks
A will, no-will inheritance rules, and beneficiary transfers are different checks. Do not distribute property based only on a simplified inheritance summary.
Steps to take
Ask a local estate lawyer or probate self-help resource which assets need a court process and who has authority to act.

County or court details: Use the court named on your papers. Ask about local forms, filing, service, fees, response dates, and hearings. A statewide form may need local additions.
Find local civil legal aid. Eligibility, scope, and availability vary; applying does not establish representation or stop a deadline.
These agencies and directories serve different purposes. Court staff explain procedure, not individualized advice. Civil legal aid is not the usual source of criminal defense.
