A detail worth knowing

Some Utah courts offer pro se calendars with free lawyer help for a hearing. The judiciary cautions that this is limited to selected case types and locations, requires an existing scheduled case, and ends after that hearing. It is not ongoing representation for the entire matter. Source: pro se calendar limits.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Utah. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $20,000, including attorney fees; money claims only.

Court costs and interest are outside the ceiling. This process cannot order the return of an item, evict someone, or hear a claim against a government agency. Some courts use online dispute resolution with its own participation deadlines. Ask a prepaid lawyer whether the remedy you need fits small claims and whether help with online negotiation is included.

Utah Courts: current small-claims limits and process

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

30 days after you vacate and return possession; missed returns have a formal notice procedure.

The balance of the deposit and prepaid rent, with explained, itemized deductions, must be sent to your last-known address or an electronic means you supplied. If that does not happen, the statutory deposit-disposition notice must be properly served and gives five business days to comply. Ask for help using the required notice and service method, not just sending a casual email.

Utah sections 57-17-3 and 57-17-5, current notice procedure

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Two witnesses for ordinary wills; handwritten and court-validation exceptions are separate.

Witnesses sign within a reasonable time after witnessing signing or acknowledgment of the signature or will. The handwritten route requires the signature and material portions in your handwriting. A noncompliant writing may qualify through clear-and-convincing proof of intent, but that is not a reason to skip proper execution. Ask your provider to explain the supported signing route.

Utah sections 75-2-502 and 75-2-503

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

A handwritten signature and material portions can qualify as a holographic will without witnesses. A typed form with only a handwritten signature is different. Ask a lawyer to check an existing note's wording and intent rather than relying on handwriting alone.

Utah Code 75-2-502(2)

Shared descendants: all; a nonshared decedent descendant: $75,000 plus half of the balance, subject to a nonprobate-transfer adjustment. In the split branch, certain transfers to the survivor are added for calculation and treated as an advancement against the spouse's share. Ask a lawyer to review beneficiary accounts, ownership, and the family tree before treating the headline formula as the amount received.

Utah Code 75-2-102

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will my plan lawyer check beneficiary transfers against the blended-family inheritance adjustment, review ownership with my will, arrange signing, and quote customized trust or tax work outside the benefit? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details

Utah: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

The ordinary filing rule requires either spouse's 90 days of residence in the filing county.

Military and specified consent-to-jurisdiction routes also exist. Ask a lawyer to check the applicable route, service, and separate child-custody jurisdiction; a wedding location alone is not enough.

Utah Code 81-4-402(1)

Grounds & separation

Irreconcilable differences are an available ground for divorce.

Ending the marriage and resolving disputed parenting or money are different questions. A prepaid consultation can help identify the issues that need individual review before using court forms.

Utah courts: grounds for divorce

Timing: what starts the clock

The ordinary minimum is 30 days after filing; the court can make an exception for extraordinary circumstances.

A waiver is not automatic just because the spouses agree. Required filings, courses, unresolved issues, and court scheduling can make the case take longer. Ask who will handle a waiver request if needed.

Utah courts: waiting-period waiver

Property & debts

Marital property is divided equitably, meaning fairly rather than necessarily equally.

Premarital, gifted, or inherited property is usually separate, but mixing or using it can change its treatment. Ask a lawyer to review tracing, debts, and retirement transfers before signing a settlement.

Utah courts: property division

Spousal support

Alimony depends on need, earning capacity, ability to pay, marriage length, and other factors; qualifying fault can matter.

Ordinarily its duration cannot exceed the marriage's length without special reasons; temporary payments count toward duration. Bring a budget and work history, and check coverage for negotiation rather than assuming a fixed award.

Utah courts: alimony

Parenting & child support

The joint-legal-custody assumption is not an assumption of joint physical custody or equal time.

Best interests and exceptions, including abuse, govern. Ask about decision-making, the actual schedule, a parenting plan, and separate child-support calculations; safety concerns need individual help.

Utah courts: custody and parent-time

Agreed & simpler processes

An agreed case still needs final papers and the judge's signed decree.

Court document tools may not generate everything required. Have a lawyer review the stipulation and the applicable children or no-children checklist; an agreement does not automatically waive the waiting period.

Utah courts: stipulations and final documents

Help while a case is pending

Temporary orders can address parenting, support, use of the home or car, and attorney fees while the case proceeds.

A motion needs supporting papers; required parenting courses can affect when it is heard, with exceptions. Ask a lawyer about urgent relief and whether motions and appearances cost extra beyond consultation.

Utah courts: temporary orders

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

Forms and local filing

Use topic-based court pages to locate relevant forms, then check the filing guidance. Filing documents with the court and serving other parties are separate procedural tasks. Confirm the correct court, accepted filing method, and required signatures rather than assuming a prepared packet completes both tasks. Self-help topics · Filing guidance.

Legal aid and finding a lawyer

The judiciary's legal-help page links nonprofit agencies and clinics, the bar's attorney directory, and limited legal help sometimes called unbundled services. Limited help can mean paying for particular tasks rather than the whole case. Confirm the agreed scope, price, and responsibilities left to you. Source: legal-help and hiring options.

Before paying for a plan or service

Is your Utah matter covered for advice, document review, negotiation, or an appearance? Ask for a task-by-task quote and compare it with a limited-service attorney arrangement for the same work.

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Utah's waiver guidance distinguishes fees that may be waived from expenses it cannot waive, including private or out-of-state process-server charges, newspaper publication, and postage or copies. Follow the instructions for your case and qualification route, including the requested order. Court fee relief is not a blanket cancellation of every expense. Source: waiver scope and instructions.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
