A detail worth knowing

The Virginia Lawyer Referral Service offers an initial consultation and states that neither party is obligated to continue beyond it. A referral fee or short consultation does not buy full representation. Confirm the current referral terms, then separately agree on the scope and price of any further legal work. Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Virginia. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $5,000 in money or personal property; lawyers do not represent parties at the small-claims trial.

This is a special General District Court division, not every civil case in that court. A defendant can remove the case to the regular docket before the judge decides it, changing the procedure and representation options. A prepaid consultation may help organize evidence or a demand beforehand; ask separately about representation if the case moves to the regular docket.

Virginia Courts: small-claims procedures

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

45 days from tenancy termination or move-out, whichever is later; some accounting can take longer.

The landlord must give written, itemized deductions and the amount due. When damage exceeds the deposit and needs a third-party contractor, timely written notice permits 15 additional days for repair-cost itemization. Early termination and unpaid utilities have further qualifications. Provide a forwarding address: without one, the landlord can continue holding the deposit in escrow. Ask for help checking the deadline and deduction notice together.

Virginia section 55.1-1226

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills need two witnesses together; handwritten wills still need proof later.

For a will not wholly in your handwriting, sign or acknowledge it before at least two competent witnesses present at the same time; they sign in your presence. A wholly handwritten, signed will has a different route, but at least two disinterested witnesses must prove the handwriting and signature. Ask your provider about both proper execution and how your family will establish validity later.

Virginia section 64.2-403

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Wholly handwritten and signed, with later proof by two disinterested witnesses. These witnesses prove the handwriting and signature; they are not ordinary witnesses required to attend a holographic signing ceremony. Arrange attorney review rather than assuming an informal note will be easy to prove.

Virginia Code 64.2-403(B)

All to the spouse with shared descendants; one-third if any are nonshared. If any surviving child line is not also the spouse's, the spouse receives one-third and the deceased's descendants two-thirds. Otherwise the spouse receives all. The personal-estate rule follows the same proportions after expenses and debts, subject to separate spouse protections.

Virginia Code 64.2-200 and 64.2-201

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will the plan lawyer help with valid execution and later proof, and review how children from an earlier relationship affect the estate? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Virginia: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Generally one spouse needs six months of genuine Virginia residence and domicile before filing.

Military and specified overseas-service situations have statutory provisions. Ask which applies and whether the court can decide financial or parenting issues involving another state.

Virginia Code 20-97

Grounds & separation

No-fault divorce generally requires a year apart; six months applies only with an agreement and no qualifying minor children.

Fault grounds are separate routes. Do not assume any signed agreement shortens a divorce involving shared minor children, or that a separation agreement itself ends the marriage.

Virginia Code 20-91(A)(9)

Timing: what starts the clock

The no-fault separation clock concerns continuous separation, not six or twelve months after every filing.

The statute requires separation without cohabitation or interruption. Ask how your actual living circumstances establish the date and what evidence is needed before relying on the shorter route.

Virginia Code 20-91: separation periods

Property & debts

Property and debts require classification; an asset can be partly marital and partly separate.

Mixed contributions and appreciation can matter. Bring acquisition and ownership records, not just today's balances, and ask whether your plan covers tracing or valuation work.

Virginia Code 20-107.3

Spousal support

Support depends on statutory factors; certain fault grounds can bar permanent support unless an exception applies.

The statute includes a manifest-injustice exception with its own proof standard. Ask about eligibility, reserving future support, and waiver consequences before using a simple income-based estimate.

Virginia Code 20-107.1

Parenting & child support

Best-interest factors govern custody and visitation, including family relationships and the child's needs.

A parenting label does not explain school, travel, daily care, or safety. Ask a lawyer to review the actual schedule and support obligations rather than assuming a standard plan fits every family.

Virginia Code 20-124.3

Agreed & simpler processes

A valid separation agreement can be incorporated into a decree and enforced as a court term.

That makes its wording consequential. Ask for independent review of the whole financial agreement, including support and retirement provisions, before exchanging signatures or relying on informal promises.

Virginia Code 20-109.1

Help while a case is pending

Pending-case orders can address support, debts, home use, children, and preservation of assets.

Temporary support rules differ from final support. Tell a lawyer what cannot wait, and confirm whether the prepaid benefit includes motion preparation and representation at the hearing.

Virginia Code 20-103

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in Virginia

Safety and law enforcement are separate routes

Forms and local filing

Before paying for a plan or service

Does the quote cover work in the court handling my case, or only an initial consultation? Who handles any local forms, service, negotiations, and appearances?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

The court self-help guide says filing fees depend on case type and location and links to fee calculators. It identifies a request for relief from filing fees that requires judicial approval and tells readers to ask the local court about processing. Use the applicable instructions and current figures rather than a single statewide estimate. Source: fees and waiver process.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
