A detail worth knowing

Wisconsin's CV-410B order includes more than a simple approval or denial. It can permit filing and sheriff service without prepayment while setting a later payment date, and approved waivers may be revisited if the court later finds an ability to pay. Read the selected provisions in your order rather than assuming that "fee relief" always means no future obligation. Source: fee-relief order options (PDF).

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Wisconsin. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Most money claims: $10,000; tort and personal-injury claims: $5,000.

The court's guide distinguishes a general money claim from a tort claim, such as injury or damage caused by wrongful conduct. It also has separate categories for eviction and return of property, so one dollar ceiling does not describe every case. Ask a prepaid lawyer to classify the dispute and the remedy before selecting a form or giving up part of a claim.

Wisconsin Courts: small-claims eligibility

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Usually 21 days; leaving before the lease ends can change when the clock starts.

State consumer guidance says a normal end-of-lease move-out starts the 21-day period. If you leave early, count from the lease's last day or a new tenant's move-in, whichever comes first, not automatically your moving day. Deductions require a written, itemized statement; routine carpet cleaning due only to normal wear cannot be taken from the deposit. Keep proof of the lease dates and replacement tenancy.

Wisconsin DATCP: tenant rights and deposit return

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Two witnesses can observe at different times; remote witnessing needs an attorney-supervised procedure.

The written will needs your signature and two witnesses signing within a reasonable time after observing signing or acknowledgment in their conscious presence. They may observe at different times. The remote route requires a Wisconsin-licensed supervising attorney, participants located in Wisconsin, identity checks, prescribed original or counterpart handling, and a compliance affidavit. Ask whether your prepaid benefit includes that supervision; an unsupervised video call is not the statutory procedure.

Wisconsin section 853.03

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwriting alone does not create an ordinary unwitnessed-will exception. An existing will can qualify through another jurisdiction's execution rules. Have a lawyer review where and how it was made before assuming a handwritten note is valid or an old will must be discarded.

Wisconsin Statutes 853.05; ordinary rules in 853.03

All shared descendants: spouse receives the intestate estate; nonshared descendants: half of specified property, not half of everything. The nonshared branch excludes the decedent's interest in marital property and property held equally and exclusively as tenants in common with the survivor. The survivor's own ownership is separate. Ask a lawyer to reconcile family relationships, title, and beneficiary accounts.

Wisconsin Statutes 852.01(1)(a)-(b)

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Can my plan lawyer check marital-property ownership, both spouses' children, and beneficiary forms alongside the will, and explain signing and any customized provisions that cost extra? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details and state comparison

Divorce law details

Wisconsin: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Divorce requires at least one spouse's six months of state residence and 30 days of residence in the filing county.

Ask a lawyer to verify residence and venue before filing. These divorce requirements differ from some annulment and legal-separation rules, and do not decide child-custody jurisdiction.

Wisconsin Statutes 767.301

Grounds & separation

The divorce ground is irretrievable breakdown; a year apart is not required for every couple.

If only one spouse asserts breakdown and there has not been a year apart, the court examines reconciliation. A consultation can separate that question from parenting, money, and safety needs.

Wisconsin Statutes 767.315

Timing: what starts the clock

The ordinary minimum is 120 days after service, or after filing a joint petition.

An emergency court order is a separate route, not an automatic waiver for an agreed case. Ask which clock applies and what required steps remain after it ends.

Wisconsin Statutes 767.335

Property & debts

Equal division is presumed for divisible property; qualifying gifts and inheritances are generally excluded, subject to hardship.

Premarital ownership is not a blanket exemption. Review valuation, tracing, and debts; a judgment does not necessarily change creditor rights, beneficiary instructions, or complete asset transfers.

Wisconsin Statutes 767.61

Spousal support

Maintenance can be limited or indefinite, based on marriage length, finances, earning capacity, and other factors.

Ask for a realistic budget and proposed-term review rather than assuming a fixed share of income. Confirm whether your plan includes advice, negotiation, or a separate representation quote.

Wisconsin Statutes 767.56

Parenting & child support

Joint legal custody and the physical-placement schedule are separate; abuse findings change the custody presumptions.

The child's best interests govern. A pattern or serious incident of domestic abuse can trigger a rebuttable presumption against custody for the abusive party. Discuss safety, decision-making, daily care, and support separately.

Wisconsin Statutes 767.41(2), (4)

Agreed & simpler processes

A qualifying agreed case may receive judgment by affidavit without an in-person hearing.

Both spouses need counsel or the specified registered lawyer-mediator route, court-approved terms, and required filings and disclosures. Ask whether your prepaid benefit covers that work; agreement alone does not qualify or erase the wait.

Wisconsin Statutes 767.235(1)(b)

Help while a case is pending

Temporary orders can address parenting, support, debts, assets, and litigation expenses.

Requests have affidavit and notice requirements; abuse restraining orders have their own process. Tell a lawyer about urgent needs and ask whether motions and appearances require additional payment.

Wisconsin Statutes 767.225

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Forms and local filing

Legal aid and finding a lawyer

Wisconsin's self-representation page links to lawyer-finding resources and explains the limits of court-staff assistance. It also warns that fixing mistakes later may cost more than obtaining advice at the outset. Ask an attorney about a defined consultation or review as well as full representation, and confirm what work each quote includes. Source: legal assistance and self-representation risks.

Before paying for a plan or service

Does the plan cover early review of my Wisconsin court documents and the later work if a dispute develops? What is included in a limited consultation, and which tasks would require a separate attorney agreement?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

CV-410A is the petition and financial declaration; CV-410B is the order deciding the request. The court's forms collection also identifies separate prisoner procedures. Use the applicable version and ask the court about remaining charges. Consult current circuit-court filing information and keep attorney expenses separate from court fee relief. Fee-relief form collection · Fees and filing.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
