A detail worth knowing

Alabama's civil hardship form requests relief from prepayment, with fees and costs to be assessed at the end of the case. Its order also reserves possible reimbursement of fees and expenses. Initial relief should not be read as permanent cancellation of every cost. Source: C-10-Civil request and order (PDF).

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Alabama. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $6,000 in the district court's small-claims division.

There is no jury in this simpler process, and either party may appeal to circuit court. Before paying to file, consider whether the other party has money or assets from which a judgment could actually be collected.

Alabama Courts: small-claims process

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

60 days after tenancy termination and delivery of possession.

A partial refund must come with an itemized accounting. Give a valid forwarding address in writing when leaving and keep proof; the statute provides fallback mailing addresses rather than letting the landlord simply ignore the refund.

Alabama Code section 35-9A-201

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

A written will needs the maker's signature and at least two witnesses.

An authorized person may sign in the maker's presence and at their direction. A prepared document still needs proper execution; ask the lawyer to arrange or explain the signing ceremony rather than assuming a notary alone completes it.

Alabama probate-judges handbook: will requirements, page 59

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

Handwriting does not ordinarily remove the two-witness requirement. An unwitnessed handwritten note is not the ordinary Alabama route. A will executed elsewhere can raise separate recognition rules; have a lawyer check rather than importing another state's exception.

Alabama Code 43-8-131: ordinary execution

Shared descendants: first $50,000 plus half the balance; otherwise half. The initial amount applies when all the deceased's surviving descendants are also the spouse's. If any are not shared, the spouse instead receives half the intestate estate. Coordinate a blended family's wishes with ownership and beneficiary transfers.

Alabama Code 43-8-41

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will the included will benefit cover our blended-family provisions, beneficiary review, and proper signing, or does customization require a separate fee? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Alabama: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Six months of residence is required when the other spouse is a nonresident.

The filing spouse must prove that residence. Do not apply this particular requirement indiscriminately to two resident spouses; venue and authority over money or children are separate questions.

Alabama Code 30-2-5

Grounds & separation

Incompatibility and irretrievable breakdown are available grounds.

Fault grounds also exist. A ground for ending the marriage does not decide the parenting arrangement or financial settlement. Ask which ground your evidence supports before buying a forms package.

Alabama Code 30-2-1

Timing: what starts the clock

A final divorce must wait until 30 days after filing have expired.

This is a minimum, not a completion promise. Temporary orders remain available during that period, so urgent housing, support, or safety questions need not wait for final divorce.

Alabama Code 30-2-8.1

Property & debts

Marital assets are divided equitably; separate-property treatment has exceptions.

Regular use for the marriage's common benefit can affect treatment of premarital, gifted, or inherited property. Retirement interests also need classification. Bring tracing records to agreement review, not just account balances.

Alabama Code 30-2-51

Spousal support

Rehabilitative support is preferred where feasible; preserving future rights matters.

Need, ability to pay, and fairness control. If final divorce contains neither an alimony award nor reserved jurisdiction, the court permanently loses authority to award rehabilitative or periodic alimony later. Review that issue before signing a waiver.

Alabama Code 30-2-57

Parenting & child support

Joint custody is considered, with a presumption when both parents request it.

Best interests remain controlling, including cooperation and abuse history. The court can order a form of joint custody without mutual consent. Do not treat the label alone as a complete daily schedule.

Alabama Code 30-3-152

Agreed & simpler processes

Agreement still requires complete papers and court approval.

Montgomery County's instructions illustrate separate requirements for cases with children, including support papers. They are local instructions, not universal statewide eligibility rules. One spouse's lawyer does not automatically represent the other.

Alabama Courts: Montgomery County divorce instructions

Help while a case is pending

Temporary orders can address parenting, support, the home, and restraints.

The 30-day final-judgment restriction does not block necessary interim orders. Ask whether your plan covers advice only or also the motion and hearing; obtain separate representation promptly when needed.

Alabama Code 30-2-8.1(b)

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Alabama. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

The State Law Library recommends checking the Administrative Office of Courts collection for a standardized form first. It distinguishes approved forms from sample forms in published volumes. The hardship search separately identifies civil, criminal, and juvenile versions; confirm the current version and local filing instructions rather than using an old generic download. Legal aid and finding a lawyer

Legal Services Alabama describes its work as free civil legal advocacy for low-income Alabamians and says its offices handle civil cases only. Its application page is a starting point for asking about eligibility, available assistance, and case acceptance. A court fee request and a legal-aid application are different processes. Service scope · Applying for assistance.

Before paying for a plan or service

Does the plan provide an Alabama attorney for the particular civil matter and court? Who handles form selection, advice, service, and appearances, and which charges remain separate from the subscription?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

C-10-Civil asks for financial information about household support, benefits, income, expenses, and assets, with a sworn statement and a separate court order. Read the current instructions and the order actually entered. Budget possible later costs separately from attorney charges and future plan payments. Source: financial affidavit and order (PDF).

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
