I am considering divorce

Practical starting guidance, not a complete Alabama legal procedure.

What to do first

Identify what must be resolved now: safety, parenting, housing, access to money, and existing court orders.

Deadlines and urgent risks

Do not confuse a minimum waiting period with a completion date. Filing, service, responses, and temporary orders have separate requirements.

Steps to take

Make a list of agreed and disputed issues. Compare mediation, collaborative work, lawyer negotiation, and court; do not treat negotiation as the default if you feel unsafe or controlled.

Understand the local process

Alabama Courts: uncontested divorce packet (PDF). Read the packet's eligibility conditions before using these forms.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Alabama. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Alabama: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Six months of residence is required when the other spouse is a nonresident.

The filing spouse must prove that residence. Do not apply this particular requirement indiscriminately to two resident spouses; venue and authority over money or children are separate questions.

Alabama Code 30-2-5

Grounds & separation

Incompatibility and irretrievable breakdown are available grounds.

Fault grounds also exist. A ground for ending the marriage does not decide the parenting arrangement or financial settlement. Ask which ground your evidence supports before buying a forms package.

Alabama Code 30-2-1

Timing: what starts the clock

A final divorce must wait until 30 days after filing have expired.

This is a minimum, not a completion promise. Temporary orders remain available during that period, so urgent housing, support, or safety questions need not wait for final divorce.

Alabama Code 30-2-8.1

Property & debts

Marital assets are divided equitably; separate-property treatment has exceptions.

Regular use for the marriage's common benefit can affect treatment of premarital, gifted, or inherited property. Retirement interests also need classification. Bring tracing records to agreement review, not just account balances.

Alabama Code 30-2-51

Spousal support

Rehabilitative support is preferred where feasible; preserving future rights matters.

Need, ability to pay, and fairness control. If final divorce contains neither an alimony award nor reserved jurisdiction, the court permanently loses authority to award rehabilitative or periodic alimony later. Review that issue before signing a waiver.

Alabama Code 30-2-57

Parenting & child support

Joint custody is considered, with a presumption when both parents request it.

Best interests remain controlling, including cooperation and abuse history. The court can order a form of joint custody without mutual consent. Do not treat the label alone as a complete daily schedule.

Alabama Code 30-3-152

Agreed & simpler processes

Agreement still requires complete papers and court approval.

Montgomery County's instructions illustrate separate requirements for cases with children, including support papers. They are local instructions, not universal statewide eligibility rules. One spouse's lawyer does not automatically represent the other.

Help while a case is pending

Temporary orders can address parenting, support, the home, and restraints.

The 30-day final-judgment restriction does not block necessary interim orders. Ask whether your plan covers advice only or also the motion and hearing; obtain separate representation promptly when needed.

Alabama Code 30-2-8.1(b)

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

What may happen next

Common questions

Can I buy a plan now for this problem?

Ask about effective dates, waiting periods, and existing-matter exclusions before paying. Do not assume a new subscription covers an issue that has already started.

Does a consultation mean I have a lawyer for the next step?

No. Confirm the scope, who will handle any filing or appearance, responsibility for deadlines, and additional fees. Get a separate engagement if required.

I need help with parenting or support

Practical starting guidance, not a complete Alabama legal procedure.

What to do first

Locate the current order, if any, and identify the change or immediate problem you need help with.

Deadlines and urgent risks

An informal agreement may not change an existing court order. Safety concerns and time-sensitive hearings need individual help.

Steps to take

Write down the practical schedule, care expenses, and communication problems. Ask which court has authority and whether a modification or enforcement request fits.

What may happen next

A court may need to approve a change. Custody, parenting time, and financial support are connected but different questions.

Documents to gather

Orders, payment records, parenting calendar, relevant messages, and the child's care and school information.

Do not enter documents or private case details into this site's search.

Can an eligible family-law lawyer explain my order and review a proposed agreement?

Steps to take

State court and legal-help directory

County or court details: Use the court named on your papers. Ask about local forms, filing, service, fees, response dates, and hearings. A statewide form may need local additions.

Find local civil legal aid. Eligibility, scope, and availability vary; applying does not establish representation or stop a deadline.

Federal and national resources

These agencies and directories serve different purposes. Court staff explain procedure, not individualized advice. Civil legal aid is not the usual source of criminal defense.
