A detail worth knowing

The State Bar distinguishes its Modest Means Program from free legal aid: the program connects moderate-income people to reduced-cost help, but participants must be able to pay. Someone unable to pay should explore legal-aid resources instead of assuming a reduced-fee program is free. Source: legal-resource and referral options.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Michigan. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $7,000; using small claims involves important rights waivers.

The court's guidance says parties give up attorney representation, a jury, and ordinary appeal rights, subject to a stated exception. Filing a larger claim here waives recovery above the limit; advice before filing can still be a separate task.

Michigan Courts: small-claims division and linked jurisdiction rules

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

A damage list and undisputed balance generally must be sent within 30 days after occupancy ends.

A written forwarding address is due within four days, subject to the landlord's required notice. A damage notice calls for a mailed response within seven days of receipt. These are different steps; missing the address affects the landlord's notice duties.

Michigan Courts: security-deposit notice and response rules

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Formal wills use two witnesses; a qualifying handwritten will can be unwitnessed.

The handwritten route needs a date, signature, and material provisions in the testator's handwriting. A typed form is not that exception. Self-proving paperwork concerns later probate proof and does not replace valid execution.

Kent County Probate Court: Michigan will types

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

A dated holographic will can omit witnesses. Your signature and the material portions must be in your handwriting, and the document must be dated. A typed document with only a handwritten signature is not this exception.

Kent County Probate Court: holographic wills

An inflation-adjusted first amount plus half the balance, even with shared descendants. When descendants survive, the spouse's initial amount is lower if none are also the spouse's descendants; half of the remaining intestate estate follows. All-shared descendants do not automatically give the spouse the whole estate. The court's table illustrates the categories, but its old dollar figures must not be used for a later death year.

Michigan Probate Benchbook: MCL 700.2102 and inflation adjustments

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Can the covered consultation explain my family's inheritance default using the death-year adjustment, and quote any customized trust work separately? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Michigan: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Ordinarily 180 days in Michigan and 10 days in the filing county.

Either spouse can meet the residence periods. County exceptions and additional rules for some nonresident-spouse cases require review; residence alone does not establish authority over every financial or parenting issue.

Michigan Legislature: MCL 552.9

Grounds & separation

No-fault breakdown; spouses need not live apart before filing.

One spouse can seek divorce even if the other objects. No-fault grounds do not mean conduct is irrelevant to every property or support question.

Michigan Legal Help: divorce basics

Timing: what starts the clock

Usually 60 days from filing without minor children; six months with them.

For unusual hardship or compelling necessity, a judge may shorten the children's waiting period, generally not below 60 days. These minimums do not predict completion or excuse response deadlines.

Michigan Legislature: MCL 552.9f

Property & debts

Marital assets and debts must be divided fairly, not necessarily equally.

Separate property usually stays with its owner, but exceptions matter. Assigning a joint debt to one spouse does not release the other from the creditor's contract; refinancing or a creditor release may be needed.

Michigan Legal Help: property and debt

Spousal support

Spousal support is case-specific, not an automatic benefit of divorce.

Relevant considerations include income, ability to work and pay, marriage length, needs, property awards, and conduct. A child-support formula is not a spousal-support formula.

Michigan Legal Help: spousal support

Parenting & child support

Custody and parenting time require a best-interests review.

The child's established custodial environment and safety can affect the decision. Support is a separate issue; shared custody is not a promise that no support will be owed.

Michigan Legal Help: custody and parenting time

Agreed & simpler processes

An agreed judgment still needs court approval and the required waiting period.

A document tool can prepare forms; it cannot decide whether your proposed property or parenting terms are fair and lawful. Choose the correct forms for children and existing orders.

Michigan Legal Help: divorce with children

Help while a case is pending

Temporary orders can address parenting, support, and preservation of property.

An emergency ex parte order may already be effective when served. Objections can have short deadlines; promptly seek advice rather than waiting for the final divorce or plan enrollment.

Michigan Legal Help: responding and temporary orders

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

Forms and local filing

The State Bar links to free, state-approved court forms and Michigan Legal Help's do-it-yourself tools. Legal aid and finding a lawyer

Michigan Legal Help organizes information by legal topic and offers a Guide to Legal Help. The State Bar provides an attorney directory, a referral service, and reduced-cost options. Ask what the initial consultation includes, whether further work requires a separate agreement, and whether an attorney is available for the relevant location and issue. Public legal-help tools · Attorney-finding options.

Before paying for a plan or service

Am I comparing free legal aid, reduced-fee attorney help, or a paid plan? Which option includes individualized review, and which tasks, costs, and deadlines remain my responsibility?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Michigan Legal Help explains how to request a fee waiver, submit it with other court documents, and respond to an adverse decision. It also says to inform the court if circumstances supporting a waiver change. Follow the current instructions and order rather than assume preparing a request is approval. Source: fee-waiver process.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
