I am considering divorce

Practical starting guidance, not a complete Michigan legal procedure.

What to do first

Identify what must be resolved now: safety, parenting, housing, access to money, and existing court orders.

Deadlines and urgent risks

Do not confuse a minimum waiting period with a completion date. Filing, service, responses, and temporary orders have separate requirements.

Steps to take

Make a list of agreed and disputed issues. Compare mediation, collaborative work, lawyer negotiation, and court; do not treat negotiation as the default if you feel unsafe or controlled.

Understand the local process

Michigan Legal Help: do-it-yourself divorce. Nonprofit self-help information; review eligibility before using the tool.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Michigan. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Michigan: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Ordinarily 180 days in Michigan and 10 days in the filing county.

Either spouse can meet the residence periods. County exceptions and additional rules for some nonresident-spouse cases require review; residence alone does not establish authority over every financial or parenting issue.

Michigan Legislature: MCL 552.9

Grounds & separation

No-fault breakdown; spouses need not live apart before filing.

One spouse can seek divorce even if the other objects. No-fault grounds do not mean conduct is irrelevant to every property or support question.

Michigan Legal Help: divorce basics

Timing: what starts the clock

Usually 60 days from filing without minor children; six months with them.

For unusual hardship or compelling necessity, a judge may shorten the children's waiting period, generally not below 60 days. These minimums do not predict completion or excuse response deadlines.

Michigan Legislature: MCL 552.9f

Property & debts

Marital assets and debts must be divided fairly, not necessarily equally.

Separate property usually stays with its owner, but exceptions matter. Assigning a joint debt to one spouse does not release the other from the creditor's contract; refinancing or a creditor release may be needed.

Michigan Legal Help: property and debt

Spousal support

Spousal support is case-specific, not an automatic benefit of divorce.

Relevant considerations include income, ability to work and pay, marriage length, needs, property awards, and conduct. A child-support formula is not a spousal-support formula.

Michigan Legal Help: spousal support

Parenting & child support

Custody and parenting time require a best-interests review.

The child's established custodial environment and safety can affect the decision. Support is a separate issue; shared custody is not a promise that no support will be owed.

Michigan Legal Help: custody and parenting time

Agreed & simpler processes

An agreed judgment still needs court approval and the required waiting period.

A document tool can prepare forms; it cannot decide whether your proposed property or parenting terms are fair and lawful. Choose the correct forms for children and existing orders.

Help while a case is pending

Temporary orders can address parenting, support, and preservation of property.

An emergency ex parte order may already be effective when served. Objections can have short deadlines; promptly seek advice rather than waiting for the final divorce or plan enrollment.

Michigan Legal Help: responding and temporary orders

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

What may happen next

You may need temporary orders before a final agreement. An agreed process still needs valid documents and court approval where required.

Common questions

Can I buy a plan now for this problem?

Ask about effective dates, waiting periods, and existing-matter exclusions before paying. Do not assume a new subscription covers an issue that has already started.

Does a consultation mean I have a lawyer for the next step?

No. Confirm the scope, who will handle any filing or appearance, responsibility for deadlines, and additional fees. Get a separate engagement if required.

I need help with parenting or support

Practical starting guidance, not a complete Michigan legal procedure.

What to do first

Locate the current order, if any, and identify the change or immediate problem you need help with.

Deadlines and urgent risks

An informal agreement may not change an existing court order. Safety concerns and time-sensitive hearings need individual help.

Steps to take

Write down the practical schedule, care expenses, and communication problems. Ask which court has authority and whether a modification or enforcement request fits.

What may happen next

A court may need to approve a change. Custody, parenting time, and financial support are connected but different questions.

Documents to gather

Orders, payment records, parenting calendar, relevant messages, and the child's care and school information.

Do not enter documents or private case details into this site's search.

Can an eligible family-law lawyer explain my order and review a proposed agreement?

I need immediate safety help

Practical starting guidance, not a complete Michigan legal procedure.

What to do first

If there is immediate danger, call 911. For domestic-violence support, use a safer device if monitoring is a concern and contact a confidential advocate.

Immediate danger: call 911. For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788.

Find a non-emergency sheriff contact; choose Michigan. Confirm the current number and jurisdiction. The directory is not dispatch or confidential advocacy.

Deadlines and urgent risks

Do not wait for a subscription to activate or a routine appointment when immediate safety is at risk. This website cannot dispatch emergency help.

Steps to take

Contact an advocate about options that fit your circumstances. Ask legal aid or the local court about protection-order procedures and available legal help.

What may happen next

An advocate can help consider a safety plan and local resources. Protection orders and emergency services are separate routes; neither is a guarantee of safety.

Documents to gather

Bring existing orders or relevant records only if safe. Do not put yourself at risk to collect evidence.

Do not enter documents or private case details into this site's search.

Which rules apply?

Statewide law, local court procedure, and federal or agency rules are different checks. Where a local rule matters, use the county and court identified on your documents.

State court and legal-help directory

County or court details: Use the court named on your papers. Ask about local forms, filing, service, fees, response dates, and hearings. A statewide form may need local additions.

Find local civil legal aid. Eligibility, scope, and availability vary; applying does not establish representation or stop a deadline.

Federal and national resources

These agencies and directories serve different purposes. Court staff explain procedure, not individualized advice. Civil legal aid is not the usual source of criminal defense.
