A detail worth knowing

Oregon distinguishes a fee waiver, which permits filing without the fee, from a deferral, which postpones payment. Read the court's actual order before treating the cost as eliminated. Source: waiver and deferral explanation.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Oregon. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Up to $10,000; attorney participation in the hearing requires permission.

You must make a good-faith effort to collect before filing and state that effort on the claim form. Lawyers may advise you, but cannot participate in a small-claims hearing without the judge's permission. A prepaid consultation can help prepare a demand and organize proof; plan coverage alone does not authorize a lawyer to appear in this procedure.

Oregon Judicial Department: January 2026 plaintiff instructions

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Generally 31 days after tenancy ends and you deliver possession.

The landlord must separately account for security deposits and prepaid rent, and return the balance. Prepaid rent can cover unpaid rent, not damage repairs; ordinary wear is excluded from damage deductions. Abandoned tenant-owned manufactured dwellings or floating homes have a special timing rule. Document the tenancy's end and possession return, and ask a lawyer which kind of payment was withheld.

Oregon ORS 90.300: deposits, prepaid rent and exceptions

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills need two witnesses; electronic records are excluded from this route.

Witnesses must see or hear the required signing or acknowledgment and sign within a reasonable time before the maker's death. A court can sometimes validate a noncompliant signed writing under a separate proof-and-notice procedure, but that is not an automatic substitute for proper execution. Ask your provider how the paper document will be signed and witnessed.

Oregon ORS 112.235 and 112.238, including 2026 applicability

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Handwritten wills and inheritance defaults

There is no ordinary witness-free option merely because a will is handwritten. A court's separate clear-and-convincing proof process for some execution defects is not a planned substitute for proper signing. Avoid leaving loved ones to litigate whether an informal document qualifies.

Oregon ORS 112.235 and 112.238

All if the deceased's descendants are shared; half if any are not. The spouse's share concerns the net intestate estate. With a nonshared descendant, the remaining half passes through the descendant rules. A basic will benefit should be checked for provisions suitable to a blended family, not assumed to solve ownership and account transfers.

Oregon ORS 112.025

These are selected rules for the intestate estate, not every account or jointly owned asset. Beneficiary designations, spouse protections, debts, and family-status exceptions need separate review. Confirm current law with a local lawyer.

Planning follow-through: Will the benefit include compliant paper execution under the 2026 rule, blended-family advice, and beneficiary coordination, and what does a trust or funding help cost extra? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Divorce law details

Oregon: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Ordinary dissolution requires one party's six months of residence or domicile.

Marrying in Oregon does not remove this period for ordinary no-fault divorce. Narrow annulment-related routes differ. Ask about interstate money and parenting authority separately.

Oregon ORS 107.075

Grounds & separation

No-fault dissolution does not require the other spouse's permission.

Irreconcilable differences can end the marriage, but unresolved parenting and money issues still need decisions. Legal separation is not the same as final divorce.

Oregon Judicial Department: family-law FAQs

Timing: what starts the clock

Agreement can simplify the process, not guarantee a finish date.

Service, complete papers, local steps, and court scheduling still matter. A judge's judgment ends the marriage, not purchase of a package. Ask the local court about the procedure rather than relying on advertised turnaround times.

Oregon Judicial Department: dissolution process

Property & debts

Property division must be just and proper; equal contribution is rebuttable.

The presumption covers acquisitions during marriage, including separately titled assets, with an exception for separately retained gifts. Full disclosure matters. Ask a lawyer to classify inherited assets before accepting a proposed split.

Oregon ORS 107.105(1)(f)

Spousal support

Support has transitional, compensatory, and maintenance categories.

Training needs, contributions to the other spouse's career, and continuing support serve different purposes. Ask which fits your circumstances before waiving support; no automatic amount follows from the label.

Oregon Judicial Department: spousal support

Parenting & child support

Joint custody needs both parents' agreement and concerns major decisions.

It can include a primary residence and does not itself decide child support. Do not confuse shared decision-making with an equal-time schedule. Ask for a workable parenting plan, including safety concerns.

Oregon ORS 107.169

Agreed & simpler processes

Summary dissolution has strict eligibility limits and consequential waivers.

Its limits include marriage length, children, real estate, and finances; the petitioner waives spousal support and most temporary orders. Ordinary agreed cases use other procedures. Cheap paperwork may not be the suitable route.

Oregon ORS 107.485

Help while a case is pending

Temporary orders can address support, property use, and parenting.

A status-quo order preserves routines but does not decide custody. Immediate-danger custody uses a distinct process. Ask which motion meets your need and whether hearings are separately charged.

Oregon Judicial Department: temporary orders

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

Forms and local filing

Statewide forms are accepted in Oregon circuit courts, but may not address every circumstance. Check the local court for additional forms and instructions. Some interactive forms are available; translated fee forms must be completed in English before filing. Court staff cannot give legal advice about which form to choose. Legal aid and finding a lawyer

Many courts have family-law facilitators who provide free information and navigation for people representing themselves, but cannot tell them what to do or predict how a judge will rule. Oregon Law Help offers another route to information and free or low-cost assistance. Confirm eligibility and whether an attorney will represent you. Court help and attorney resources · Finding legal help.

Before paying for a plan or service

What attorney services does the paid option add beyond public forms and facilitator information? Does coverage include the relevant county's paperwork and court appearances, and which costs remain my responsibility?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

Use the judiciary's current fee schedules for the applicable court and filing rather than a generic online estimate. If payment is a barrier, review the waiver or deferral application and confirm any ongoing obligation in the court's order. Service, attorney work, and other expenses should be budgeted separately. Court fee schedules · Fee-relief forms.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
