Before you rely on a plan

A state rule does not tell you whether a plan covers your issue. Check the product, effective date, existing-matter rules, lawyer network, and extra costs.

A detail worth knowing

The Pennsylvania Bar Association's referral service covers 47 of the state's 67 counties. For the other counties it directs people to county bar referral services. A statewide-looking service is not necessarily the right intake point for every location. Source: referral coverage and county directory.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Pennsylvania. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Magisterial district courts hear eligible civil claims up to $12,000, excluding interest and costs.

The amount is not the only test: claim type and the proper court matter. Philadelphia uses a different minor-court structure; confirm venue before filing.

Pennsylvania Title 42 section 1515

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

30 days from lease termination or surrender and acceptance, whichever happens first.

The residential rule requires a damages list and payment of the remaining amount, subject to permitted withholding. Give your new address in writing: failing to do so relieves the landlord of liability under this section.

Landlord and Tenant Act section 512

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

A personally signed will generally needs writing and a signature at the end, not the usual two execution witnesses.

Signing by mark or through another person has two-witness safeguards. Execution is not the same as proving the will later; ask about signing and probate proof rather than assuming no witnesses are ever useful.

Pennsylvania Title 20 section 2502

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Planning follow-through: Would a witnessed, self-proved will ease later proof, and does the quoted service include that procedure? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Pennsylvania: the important distinctions

Reviewed October 11, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

At least one spouse must be a bona fide Pennsylvania resident for six months.

This is the state residence condition before starting the action. County venue, proper service, and jurisdiction over financial or child-related issues still require their own checks.

Pennsylvania Divorce Code 3104

Grounds & separation

No-fault routes include mutual consent and irretrievable breakdown after separation.

The one-year separation route generally applies to separations beginning on or after December 5, 2016; older separations have a different period. Fault grounds and a limited presumed-consent provision also exist.

Pennsylvania Divorce Code 3301

Timing: what starts the clock

For mutual consent, court instructions require 90 days after complaint service.

Both spouses then file consent affidavits and complete the remaining notice and filing steps. Do not confuse this with the separate one-year separation route or a guaranteed 90-day finish.

Pennsylvania Courts: consent-divorce steps (PDF)

Property & debts

Marital property is divided equitably, not automatically 50/50.

Liabilities, contributions, economic circumstances, and the children's housing are among relevant factors. Property title alone does not settle classification; preserve financial claims before seeking a decree.

Pennsylvania Divorce Code 3501-3502

Spousal support

Post-divorce alimony requires a finding that it is necessary.

The court considers earnings, needs, marriage length, property, and other factors. Support while separated or during litigation is different from post-divorce alimony; one should not be assumed from the other.

Pennsylvania Divorce Code 3701-3702

Parenting & child support

Custody centers on best interests with particular weight on safety.

A proposed parenting arrangement needs review of abuse and safety factors, not just agreement on a calendar. Child support is a separate process, not a benefit supplied by a divorce-only forms packet.

Pennsylvania custody law 5328

Agreed & simpler processes

State court forms cover specific no-fault routes, not every related claim.

Read the full packet and county instructions. A simple divorce filing does not automatically preserve property or alimony rights or decide custody; ask about claims before obtaining the decree.

Pennsylvania Courts: divorce proceedings and forms

Help while a case is pending

Interim spousal support, litigation support, and counsel fees may be available.

Alimony pendente lite means support during the case, not a final alimony award. It must be requested and eligibility matters; do not assume attorney fees will be reimbursed.

Pennsylvania Divorce Code 3702

Ask your prepaid plan: Is a consultation or agreement review available for these issues? Confirm pre-existing-matter rules, waiting periods, conflicts if both spouses are members, and separate charges for negotiation or court representation. State law is not a promise of plan coverage.

Minimum legal periods are not completion estimates. Do not delay urgent advice or miss a claim deadline while waiting for a benefit.

Divorce information in Pennsylvania

Understand the local process

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Pennsylvania. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Forms and local filing

The judiciary's divorce page separates form groups for different grounds and tells users to check county procedures. It warns that representing yourself does not excuse compliance with state and local rules. Do not buy a generic packet without checking whether it fits the proceeding and includes local documents. Legal aid and finding a lawyer

Pennsylvania Legal Aid Network links to civil legal-aid providers, public legal information, and private-lawyer referral options. A referral or a brief consultation is different from ongoing representation. Confirm consultation terms and the price and scope of any further work before agreeing to an engagement. Before paying for a plan or service

Which statewide and county-specific forms are included? If my case involves financial claims or disagreement, who advises me and what work is excluded from the quote?

  1. Request the plan document that applies to your location and enrollment, not just a national benefits summary.
  2. Ask for a written answer about the specific matter, effective date, existing-matter rules, network attorneys, and service limits.
  3. Separate consultation, document preparation, attorney review, negotiation, and court representation. Ask exactly which tasks the quote includes.

Public court resources and legal-aid eligibility are not evidence that a commercial plan covers the same issue. Use the policy checklist and provider policy examples to organize questions.

Build a realistic budget

The court's divorce page describes an In Forma Pauperis application for people unable to afford filing fees and notes that filing costs vary by county and document. Follow the local submission instructions and await the court's determination; the availability of an application is not approval. Source: fee-relief instructions.

Compare future plan payments and uncovered expenses with a direct quote for the same work. Past nonrefundable dues are not savings you can recover by buying more coverage. The cost calculator and future payments and cancellation help separate those decisions.

Before filing or signing

Confirm the current instructions, deadlines, and local rules. If an issue involves safety, disputed rights, or a deadline, seek timely qualified help; do not wait for a new subscription to resolve a coverage question.
