Before you rely on a plan

A state rule does not tell you whether a plan covers your issue. Check the product, effective date, existing-matter rules, lawyer network, and extra costs.

A detail worth knowing

TexasLawHelp describes a Statement of Inability to Afford Payment of Court Costs or an Appeal Bond as the route to request a court fee waiver. Read the current instructions and eligibility information rather than assuming a waiver is automatic. Source and current instructions.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for Texas. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

Justice-court small claims can reach $20,000.

The court is not automatically the right venue for every dispute. Its rules distinguish small claims, debt claims, repairs, and eviction; an individual may use an attorney.

Texas State Law Library: small claims

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Generally 30 days after surrender; a written forwarding address matters.

The landlord is not obliged to refund or itemize until you provide a forwarding address in writing. Failing to provide it does not itself forfeit the refund right.

Texas State Law Library: deposits

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary wills need two credible witnesses aged at least 14; wholly handwritten wills have an exception.

Witnesses sign in the testator's presence. The holographic exception is for a will wholly in the testator's handwriting, not simply a signed typed template.

Estates Code sections 251.051-251.052

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Planning follow-through: Does the drafting service include an appropriate self-proving procedure, and who arranges it? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

Texas: the important distinctions

Reviewed October 10, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Ordinary filing rule: 6 months domiciled in Texas and 90 days in the county.

Either spouse can meet the rule. Separate provisions address a nonresident filing against a Texas spouse and military/service residence. Residence is not the only jurisdiction question.

Texas Family Code 6.301-6.304

Grounds & separation

No-fault insupportability is available; fault grounds also exist.

Living apart for three years is an alternative statutory ground, not a required separation period for every no-fault divorce.

Texas Family Code 6.001-6.007

Timing: what starts the clock

Generally no divorce before the 60th day after the petition is filed.

Certain family-violence exceptions involve a qualifying conviction/deferred adjudication or an active protective/emergency order. They are not a general waiver for every allegation. The case can take longer.

Texas Family Code 6.702

Property & debts

Community property does not mean a mandatory 50/50 division.

The court divides the marital estate in a just-and-right manner. Separate property is treated differently. Identify debts and ownership carefully before signing an agreement.

Texas Family Code 7.001

Spousal support

Court-ordered maintenance has specific eligibility requirements.

Insufficient property to meet minimum reasonable needs must be paired with a qualifying path, such as certain family-violence offenses, disability, care of a disabled child, or a marriage of at least ten years with insufficient earning ability. Ten years alone does not qualify someone.

Texas Family Code 8.051-8.055

Parenting & child support

Custody is called conservatorship; possession schedules and support are separate issues.

The child's best interests guide decisions. A divorce involving children includes custody, visitation, child support, and medical-support orders; sharing decision-making does not itself promise equal time.

Texas Law Help: conservatorship

Agreed & simpler processes

Agreed divorce forms can help when their scope fits your circumstances.

Use the correct packet for children and existing orders. A packet is not suitable for every property, maintenance, or jurisdiction issue, and agreement does not remove the required court steps.

Texas Law Help: agreed divorce with children

Help while a case is pending

Temporary orders can address children and property while the case is pending.

Temporary restraining orders and family-violence protective orders are different tools. Ask about the correct procedure, hearing, and safety protections before using forms.

Texas Law Help: temporary orders

Minimum legal periods are not completion estimates. See the timing explanation above before planning around a date.

Divorce information in Texas

Understand the local process

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose Texas. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Compare the kind of help you need

Court information
Use forms, instructions, and local court resources to understand the process.
Document preparation
Ask what is prepared, what you must complete yourself, and whether local forms are included.
Attorney review or advice
Ask whether a licensed attorney reviews your facts and documents, and what that service costs.
Representation
Confirm whether the engagement includes negotiation, hearings, or the entire matter. A consultation alone does not establish that scope.

Questions for the court and provider

For the court or self-help resource: Does this guide match my children, property, and existing court orders, and what filing requirements does the local court use?

For the plan: Is my specific issue covered in Texas? What effective-date, existing-matter, network, and extra-cost rules apply?

Choose resources that match your circumstances; a questionnaire's convenience does not settle questions about custody, support, or property.

Build a realistic budget

Separate the service price from court costs and any additional work. Ask whether a fee-waiver procedure is relevant. Use the cost calculator with an actual quote and the payments you still owe.

For civil legal-aid options, the Legal Services Corporation locator can identify nearby funded organizations. Each organization determines eligibility and available assistance.
