Before you rely on a plan

A state rule does not tell you whether a plan covers your issue. Check the product, effective date, existing-matter rules, lawyer network, and extra costs.

A detail worth knowing

California Courts says the basic divorce forms are statewide, but your court may require additional local forms. Its forms guide lists filing fees of $435-$450; check the court's current fee schedule before budgeting. Source and current instructions.

Legal help beyond divorce

Protect your home, money, and plans

Three sourced distinctions for California. Reviewed October 10, 2026. Exceptions and local rules still matter.

Small claims

$12,500 for an individual; generally $6,250 for a business.

A modest consumer dispute may fit a simpler court process. Check claim type and eligibility before giving up an amount above the limit.

California Courts: small claims

Ask your prepaid planAsk whether advice, a demand letter, or preparation is included. Court appearance and collecting a judgment are separate questions.

Rental deposits

Generally 21 days after move-out for the refund or deductions statement.

Keep move-in and move-out evidence. Repair estimates and later receipts have additional rules; the deadline is not permission to deduct for ordinary wear.

California Courts: deposit disputes

Ask your prepaid planAsk whether lease review or help responding to a deduction notice is covered. Confirm whether tenant work, landlord work, and representation have different limits.

Wills

Ordinary witnessed wills and qualifying handwritten wills follow different rules.

The usual witnessed route requires at least two witnesses present together for signing or acknowledgment. A holographic will requires handwritten material provisions and signature; a downloaded form is not automatically that exception.

Probate Code sections 6110-6111

Ask your prepaid planAsk whether a simple will, revisions, and signing guidance are included. Trusts, tax planning, or probate work may need a different benefit or paid engagement.

Planning follow-through: Will the lawyer provide signing instructions and check that my beneficiary forms match the plan? Compare will-signing rules and prepaid help. Estate comparison reviewed October 11, 2026.

Consumer debt

A collection letter and a court summons need different responses.

Ask a local lawyer about the debt type, limitation period, response deadline, and any protected income or property. A generic deadline from another state may not apply.

CFPB: debt-collection rights and responses (federal resources, not a state-law comparison).

Ask your prepaid planConfirm whether reviewing a collection notice or defending a suit is included. A benefit is not debt forgiveness or a promise to stop collection.

California: the important distinctions

Reviewed October 10, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Usually 6 months in California and 3 months in the county.

One spouse must meet both residence periods before a standard divorce filing. A limited exception exists for some same-sex couples married in California; authority over money or children may still be limited.

California Courts: residency

Grounds & separation

No-fault divorce; no general requirement to live apart first.

Irreconcilable differences are the usual ground. Legal separation is a different process and does not end the marriage.

California Courts: divorce basics

Timing: what starts the clock

Standard divorce: at least 6 months after service or the other spouse's court response.

This is not six months from every filing. Summary dissolution uses six months from the joint filing. Completing paperwork and obtaining judgment can take longer.

California Courts: divorce versus separation

Property & debts

Community property is generally divided equally; separate property is different.

Classifying assets and debts matters before dividing them. Mixed funds, retirement benefits, out-of-state acquisitions, agreements, and special debt rules may need individual advice.

California Courts: property and debt rules

Spousal support

Temporary and longer-term support serve different purposes.

Longer-term support considers statutory factors, including earning capacity, needs, ability to pay, marriage duration, health, and domestic violence. It is not an automatic award or a single universal formula.

California Courts: longer-term support

Parenting & child support

Parenting arrangements must serve the child's best interests.

Custody and parenting time address care, residence, and decisions. Child support and health insurance also need attention. Domestic-violence rules can change the analysis; agreement alone is not the whole legal test.

California Courts: parenting and support agreements

Agreed & simpler processes

Joint petitions are available from 2026; summary dissolution has narrower eligibility.

Joint filing requires agreement on all final terms and does not finish the case. Temporary orders cannot be requested in that joint process. Summary dissolution is a separate option for qualifying short marriages with limited property/debt and no children together.

California Courts: joint petition

Help while a case is pending

Ask about temporary parenting or financial orders when you cannot wait for a final agreement.

The procedure depends on the kind of case. If safety is a concern, seek confidential advocacy or legal help rather than treating joint filing or negotiation as the default.

California Courts: decisions during divorce

Minimum legal periods are not completion estimates. See the timing explanation above before planning around a date.

Divorce information in California

Understand the local process

California Courts: divorce self-help. Use the court's instructions for the process that fits your circumstances.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose California. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

Compare the kind of help you need

Court information
Use forms, instructions, and local court resources to understand the process.
Document preparation
Ask what is prepared, what you must complete yourself, and whether local forms are included.
Attorney review or advice
Ask whether a licensed attorney reviews your facts and documents, and what that service costs.
Representation
Confirm whether the engagement includes negotiation, hearings, or the entire matter. A consultation alone does not establish that scope.

Questions for the court and provider

For the court or self-help resource: Which statewide forms, local forms, and court fees apply where I will file?

For the plan: Is my specific issue covered in California? What effective-date, existing-matter, network, and extra-cost rules apply?

A document package should account for any local forms and the filing process, not just populate the basic statewide forms.

Build a realistic budget

Separate the service price from court costs and any additional work. Ask whether a fee-waiver procedure is relevant. Use the cost calculator with an actual quote and the payments you still owe.

For civil legal-aid options, the Legal Services Corporation locator can identify nearby funded organizations. Each organization determines eligibility and available assistance.
