Legal help in California

A family-law question does not always mean hiring a lawyer for an entire case. Start with the decision in front of you, then separate advice or document review from the work of filing, negotiating, and appearing in court.

Compare California divorce rules with another state

Custody, support, and protection-order routes checked October 15, 2026. The divorce-law comparison retains its October 10 review date. Statewide starting points, not a complete family-law manual; local forms and individual circumstances still matter.

I am considering divorce

Practical starting guidance, not a complete California legal procedure.

What to do first

Identify what must be resolved now: safety, parenting, housing, access to money, and existing court orders.

Deadlines and urgent risks

Do not confuse a minimum waiting period with a completion date. Filing, service, responses, and temporary orders have separate requirements.

Steps to take

Make a list of agreed and disputed issues. Compare mediation, collaborative work, lawyer negotiation, and court; do not treat negotiation as the default if you feel unsafe or controlled.

Understand the local process

California Courts: divorce self-help. Use the court's instructions for the process that fits your circumstances.

Check the local court's forms, filing and service requirements, response deadlines, and fee-waiver instructions. A form packet is not individualized legal advice.

Safety and law enforcement are separate routes

Immediate danger: call 911. 911 information is not an online emergency-response service.

For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788. Safety-first divorce guidance. Use a safer device if monitoring is a concern.

For a non-emergency law-enforcement contact, WomensLaw's sheriff-department directory lets you choose California. Confirm jurisdiction and the current local number; not every matter belongs to a sheriff. This is a directory, not emergency dispatch or confidential advocacy.

California: the important distinctions

Reviewed October 10, 2026. General information; exceptions and jurisdiction questions require individual review.

Where you can file

Usually 6 months in California and 3 months in the county.

One spouse must meet both residence periods before a standard divorce filing. A limited exception exists for some same-sex couples married in California; authority over money or children may still be limited.

California Courts: residency

Grounds & separation

No-fault divorce; no general requirement to live apart first.

Irreconcilable differences are the usual ground. Legal separation is a different process and does not end the marriage.

California Courts: divorce basics

Timing: what starts the clock

Standard divorce: at least 6 months after service or the other spouse's court response.

This is not six months from every filing. Summary dissolution uses six months from the joint filing. Completing paperwork and obtaining judgment can take longer.

California Courts: divorce versus separation

Property & debts

Community property is generally divided equally; separate property is different.

Classifying assets and debts matters before dividing them. Mixed funds, retirement benefits, out-of-state acquisitions, agreements, and special debt rules may need individual advice.

California Courts: property and debt rules

Spousal support

Temporary and longer-term support serve different purposes.

Longer-term support considers statutory factors, including earning capacity, needs, ability to pay, marriage duration, health, and domestic violence. It is not an automatic award or a single universal formula.

California Courts: longer-term support

Parenting & child support

Parenting arrangements must serve the child's best interests.

Custody and parenting time address care, residence, and decisions. Child support and health insurance also need attention. Domestic-violence rules can change the analysis; agreement alone is not the whole legal test.

California Courts: parenting and support agreements

Agreed & simpler processes

Joint petitions are available from 2026; summary dissolution has narrower eligibility.

Joint filing requires agreement on all final terms and does not finish the case. Temporary orders cannot be requested in that joint process. Summary dissolution is a separate option for qualifying short marriages with limited property/debt and no children together.

California Courts: joint petition

Help while a case is pending

Ask about temporary parenting or financial orders when you cannot wait for a final agreement.

The procedure depends on the kind of case. If safety is a concern, seek confidential advocacy or legal help rather than treating joint filing or negotiation as the default.

Minimum legal periods are not completion estimates. See the timing explanation above before planning around a date.

What may happen next

You may need temporary orders before a final agreement. An agreed process still needs valid documents and court approval where required.

Which rules apply?

Statewide law, local court procedure, and federal or agency rules are different checks. Where a local rule matters, use the county and court identified on your documents.

I need help with parenting or support

Practical starting guidance, not a complete California legal procedure.

What to do first

Locate the current order, if any, and identify the change or immediate problem you need help with.

Deadlines and urgent risks

An informal agreement may not change an existing court order. Safety concerns and time-sensitive hearings need individual help.

Choose the right California route

  1. No family case yet? A custody request needs a family-law case. Ask the court's self-help center which case fits, especially if legal parentage is unresolved. Do not assume divorce paperwork is right for unmarried parents. California parentage cases.
  2. Need a new or changed order? California's Request for Order process uses form FL-300 for many custody and support requests in an existing case. Filing is followed by service and a hearing; custody disputes also involve mediation or recommending counseling. Request for Order instructions and custody-specific steps.
  3. Mostly a child-support problem? The local child support agency helps establish and enforce support orders. That service is different from hiring your own lawyer to address custody. Start with the court's support resources and county agency finder.

An agreement and an order are different

For example, agreeing by text to a new schedule is not the same as getting a judge to approve a replacement order. A covered consultation could help you identify what needs formal approval before a disagreement arises.

California Courts: making an agreement a court order. Custody and support use their own instructions.

If mediation does not feel safe

Tell Family Court Services about abuse or a restraining order before the appointment. In the circumstances described by the court, you have a right to a separate meeting and may bring a support person. Ask what information can be shared with the other parent; do not assume the session is confidential.

California Courts: safety arrangements in custody mediation. This is a court-process safeguard, not a recommendation to negotiate with someone who intimidates or controls you.

Bring to the first conversation

  • Current orders, case number, hearing papers, and proof of service.
  • A proposed parenting schedule and the specific change you need.
  • Income, support-payment, child-care, and health-insurance records.

Do not enter documents or private case details into this site's search.

Free help versus your own lawyer

California court self-help programs are free and can help with forms. They do not represent you, both sides may use them, and conversations are not protected by attorney-client privilege. A private or plan lawyer can provide individualized advice within the engagement you agree to.

What California court self-help can and cannot do.

Statewide rule, local appointment

Check your county's filing, service, mediation, and hearing instructions. A move, another state's order, or an urgent safety issue calls for individual advice about which court can act.

Can an eligible family-law lawyer explain my order and review a proposed agreement?

What it may not cover

A consultation is not an agreement to handle a custody dispute or enforce an order. Family litigation may be excluded or separately billed.

Ask for the written coverage terms · Compare the actual extra costs

Common questions

Will the plan lawyer attend my custody hearing?

Not just because a consultation was included. Ask whether the exact custody or support matter, document preparation, service, and appearance are covered. Confirm who handles deadlines and obtain a written quote for excluded work.

Can I enroll after a dispute has started?

Ask about the effective date, waiting periods, existing-matter rules, and conflicts if the other parent is also covered. Keep responding to court papers while coverage is being checked.

I need immediate safety help

Practical starting guidance, not a complete California legal procedure.

What to do first

If there is immediate danger, call 911. For domestic-violence support, use a safer device if monitoring is a concern and contact a confidential advocate.

Immediate danger: call 911. For domestic-violence support: National Domestic Violence Hotline, 800-799-7233, or text START to 88788.

Find a non-emergency sheriff contact; choose California. Confirm the current number and jurisdiction. The directory is not dispatch or confidential advocacy.

Deadlines and urgent risks

Do not wait for a subscription to activate or a routine appointment when immediate safety is at risk. This website cannot dispatch emergency help.

A California protection-order starting point

  1. Check which order fits. Domestic-violence orders apply to qualifying relationships. A neighbor or coworker dispute may use another kind of order. Compare California restraining-order types with a self-help center or advocate.
  2. Use the right forms and local filing route. The state's domestic-violence form guide explains DV-100 and related forms. If you need child-related orders, ask about the additional custody forms. Confirm any county supplements.
  3. Plan for service and the hearing. A temporary decision is not the end of the case. Follow the judge's papers and get help arranging safe service; do not put yourself at risk delivering papers.

You do not need to buy a plan to ask for protection

California Courts explains that requesting a domestic violence restraining order has no court filing fee and does not require a lawyer. Free court self-help or legal aid may help with the process. A plan can be an additional route to legal advice if eligible, not a prerequisite for seeking help.

California Courts: domestic violence restraining orders. Other kinds of restraining orders can have different fee rules.

Safety and custody overlap

Tell the court and your lawyer about abuse and existing protective orders. California has special custody rules involving domestic violence; this is not a situation to treat as a routine negotiated parenting plan.

California Courts: domestic violence and child custody.

Bring only what is safe to gather

Existing orders, hearing papers, and records of incidents may help. Do not risk your safety to collect evidence or upload private case details to this site.

Who does what?

  • Emergency services: immediate danger, not document advice.
  • Advocates: safety planning and support.
  • Court self-help: procedural and form assistance, not your confidential lawyer.
  • Your lawyer: individual legal advice and any specifically agreed representation.

If papers were served on you

Read and obey any temporary orders, note the hearing date, and seek prompt advice about responding. This guide does not assess the allegations or replace a defense lawyer.

Where prepaid help may fit

Can my existing plan connect me promptly to advice about protection orders or related family issues?

What it may not cover

A legal plan is not emergency response or confidential safety planning. Do not assume it includes representation at an urgent hearing.

Ask for the written coverage terms · Compare the actual extra costs

Common questions

Should I wait for the plan to approve a lawyer?

Do not delay emergency help or a time-sensitive court response while waiting for coverage. Use an advocate, court self-help, or legal aid to identify available help, and ask the plan separately about an urgent consultation or representation.

Is talking to court self-help confidential?

Court self-help is not your lawyer and does not provide attorney-client confidentiality. Before sharing sensitive details, understand whom you are speaking with and the service's confidentiality limits. Ask an advocate about safer ways to seek support if your device is monitored.
